Hill &#8211; March 12, 2013<\/p>\n<p>Recently, a great case came out of the Virginia Supreme Court that gives great insight into the way that the Virginia court system will analyze the timing, value and priority of liens.\u00a0 That case is <a href=\"http:\/\/constructionlawva.com\/wp-content\/uploads\/2013\/03\/Glasser-Glasser-v-Jack-Bays-Inc-et-al..pdf\" target=\"_blank\" rel=\"nofollow\">Glasser &amp; Glasser v Jack Bays, Inc et al.<\/a><\/p>\n<p>This case gets a great discussion from my friend <a href=\"http:\/\/www.vaconstructionlawupdate.com\/2013\/03\/11\/supreme-court-opinion-concerning-a-multitude-of-mechanics-lien-issues\/\" rel=\"nofollow\">Spencer Wiegard<\/a> over at the Virginia Construction Law Update, so I won\u2019t get into the nitty gritty details but so deeply here.\u00a0 Suffice it to say that a church construction project went kaput over financing, the project terminated (over time) and the general contractor and its subcontractors all filed liens.<\/p>\n<p>Due to the timing and method of termination, the general contractor stopped work prior to the subcontractors stopping work.\u00a0 Also, just for fun, some bond holders had a tangential interest in the property, but were not named in the lawsuits that were timely filed to enforce the liens.<\/p>\n<p>Based on this scenario and the subsequent appeal by the lenders, the Virginia Supreme Court had a great opportunity to discuss the applications of the so called 90 day rule, <a href=\"http:\/\/constructionlawva.com\/reasons-talk-construction-lawyer-early-project\/\" target=\"_blank\" rel=\"nofollow\">the 150-day \u201clookback\u201d rule<\/a>, what parties are necessary to the proper prosecution of a mechanic\u2019s lien suit, and priority of liens (among a few other items).\u00a0 In short, it makes a great starting point for any Virginia construction practitioner to analyze a <a href=\"http:\/\/constructionlawva.com\/mechanics-liens\/\" target=\"_blank\" rel=\"nofollow\">mechanic\u2019s lien claim<\/a>.<\/p>\n<p>Because of its comprehensive nature and its application of the mechanic\u2019s lien statutes to the facts of this particular situation, I highly recommend that you read both Spencer\u2019s discussion of the case and the case itself (both of which are linked above).<\/p>\n<p>via <a href=\"http:\/\/constructionlawva.com\/great-va-supreme-court-opinion-on-mechanics-liens\/?utm_source=feedburner&amp;utm_medium=email&amp;utm_campaign=Feed%3A+ConstructionLawMusings-RichmondVa+%28Construction+Law+Musings-+Richmond%2C+VA%29\">A Great VA Supreme Court Opinion on Mechanic\u2019s Liens | Construction Law Musings- Richmond, VA<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Christopher G.
