{"id":1496,"date":"2013-04-09T06:25:31","date_gmt":"2013-04-09T12:25:31","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=1496"},"modified":"2013-04-02T16:25:48","modified_gmt":"2013-04-02T22:25:48","slug":"errors-in-design-of-building-exterior-not-related","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/errors-in-design-of-building-exterior-not-related\/","title":{"rendered":"Errors in Design of Building Exterior not Related"},"content":{"rendered":"<p>March 26, 2013<\/p>\n<p>The United States District Court for the Southern District of New York, applying New York law, held that the term \u201crelated\u201d in a professional liability insurance policy was unambiguous and held that the insured\u2019s alleged wrongful acts were \u201crelated\u201d if there was a factual tie or linkage between the wrongful acts. Dormitory Auth. of N.Y. v. Continental Cas. Co., 2013 WL 840633 (S.D.N.Y. Mar. 5, 2013).\u00a0 The court also held that two errors in the design of a building\u2019s exterior wall were not factually linked because the genesis and manifestation of the design errors were distinct.<\/p>\n<p>The insured, an architectural firm, was retained to assist with a building\u2019s design.\u00a0 During construction, the building owner demanded damages from the architectural firm for alleged deficiencies in the design of the building\u2019s exterior wall supports.\u00a0 After construction of the building, the building owner alleged that the use of corrugated panels and components on the building\u2019s sloped exterior caused the build-up of ice, which created hazardous conditions when falling from the building.\u00a0 The insurer contended that the claims for the design errors for the building support and ice build-up constituted related claims, which was defined as claims arising out of \u201crelated wrongful acts.\u201d<\/p>\n<p>The court first held that the term \u201crelated\u201d was unambiguous and required a factual tie or linkage between wrongful acts.\u00a0 The court then held that there was no factual tie between the design errors because the errors were caused by two different design teams, the errors involved different architectural considerations, the errors resulted in separate harms and the errors caused harm at different times.\u00a0 Rejecting the insurer\u2019s contention that the design errors were related because they both concerned the exterior wall, the court reasoned that there was no \u201cfactual linkage of one or more aspects of the design that gave rise\u201d to the errors.\u00a0 In addition, the court held that generalized allegations of design errors in the claim made for alleged deficiencies in the exterior wall supports did not encompass \u201cdesign errors relating to all aspects of the project or even the exterior wall\u201d but only those specific design errors outlined in the claim.<\/p>\n<p>via <a href=\"http:\/\/www.lexology.com\/library\/detail.aspx?g=1d36ef64-7975-47da-9f18-2e12c07db1b8&amp;utm_source=Lexology+Daily+Newsfeed&amp;utm_medium=HTML+email+-+Body+-+Other+states+section&amp;utm_campaign=Lexology+subscriber+daily+feed&amp;utm_content=Lexology+Daily+Newsfeed+2013-04-02&amp;utm_term=\">Errors in design of building exterior not related &#8211; Lexology<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>March 26, 2013 The United States District Court for the Southern District of New York, applying New York law, held that the term \u201crelated\u201d in a professional liability insurance policy was unambiguous and held that the insured\u2019s alleged wrongful acts were \u201crelated\u201d if there was a factual tie or linkage between the wrongful acts.
