{"id":1525,"date":"2013-04-17T06:22:27","date_gmt":"2013-04-17T12:22:27","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=1525"},"modified":"2013-04-16T16:33:26","modified_gmt":"2013-04-16T22:33:26","slug":"bills-target-nevadas-construction-defect-law","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/bills-target-nevadas-construction-defect-law\/","title":{"rendered":"Bills Target Nevada&#8217;s Construction Defect Law"},"content":{"rendered":"<p>Construction defect laws intended to protect consumers have morphed into a trial lawyer\u2019s dream and a nightmare for Nevada\u2019s building trades, putting many out of business and sending the cost of insurance skyrocketing, representatives of the homebuilding and construction industry said Friday.<\/p>\n<p>But in testimony before the Senate Judiciary Committee, homeowners recalled their own nightmares of shoddy workmanship, faulty plumbing and poor engineering that were fixed only after lawsuits were filed.<\/p>\n<p>There was little consensus over SB161, presented by Senate Minority Leader Michael Roberson, R-Henderson. SB161 is one of several bills dealing with construction defect reforms, long a priority for Republicans.<\/p>\n<p>The bill would define a constructional defect as a flaw that \u201cpresents an unreasonable risk of injury to a person or property.\u201d It would also reduce the time in which lawsuits could be filed and remove attorney\u2019s fees from recoverable damages.<\/p>\n<p>Roberson said the legislation is \u201ccritical to putting Nevadans back to work.\u201d<\/p>\n<p>He said the law when adopted in 1995 was \u201cdesigned as a consumer protection device.\u201d<\/p>\n<p>\u201cUnfortunately, 18 years later the intent of this law is hardly recognizable,\u201d he said.<\/p>\n<p>Roberson and other backers of the bill cited a recent study by the University of Nevada, Las Vegas that said while new home sales plunged 86 percent between 2000 and 2012, construction defect claims rose 355 percent. Since 2006, the number of claims per new home in Nevada is 38 times the national average, the report said.<\/p>\n<p>\u201cIt\u2019s no longer a question of whether this is a crisis,\u201d Roberson said.<\/p>\n<p>Homebuilders complained of predatory behavior by lawyers who solicit homeowners to join lawsuits, even if they have no major problems. They also argued that the legal process prevents contractors from working with homeowners to fix problems once a construction default suit is filed, leading to expensive, drawn out litigation.<\/p>\n<p>Josh Hicks, an attorney representing the Coalition for Fairness in Construction, referenced one pending case where lawyers in a suit over $15,000 are seeking $1.5 million in fees.<\/p>\n<p>Jesse Haw, president of Hawco Homes in Sparks and co-chairman of the coalition, said since 1990, his company has built more than 1,500 homes in the Reno-Sparks area and at one time employed 200.<\/p>\n<p>\u201cWe didn\u2019t have one single lawsuit,\u201d he said. \u201cWhen something was wrong with the house, we fixed it.\u201d<\/p>\n<p>But he said his insurance premiums jumped from $37,000 in 1997 to $749,000 five years later.<\/p>\n<p>\u201cIt effectively pushed our company out of the market,\u201d he said. \u201cToday we have three employees.\u201d<\/p>\n<p>\u201cIf there\u2019s an issue with a house, builders want to fix them and homeowners want them fixed,\u201d Haw said. \u201cWe believe litigation should be the last option rather than the first.\u201d<\/p>\n<p>But there was little sympathy from homeowners who\u2019ve had to deal with major defects, like broken pipes in the walls.<\/p>\n<p>Tracy Rhodes first noticed a discoloration on the baseboard in 2007.<\/p>\n<p>\u201cMushrooms were growing from behind my dishwasher,\u201d she said. \u201cMy builder no longer existed.\u201d<\/p>\n<p>\u201cBy 2010, I was broke, homeless and alone.\u201d<\/p>\n<p>Ralph Walker, a retired trial lawyer, said he and his wife built their \u201cdream house\u201d in Reno for around $500,000. Within three years it was settling. His floors sagged 6 inches. Concrete was cracking. Door wouldn\u2019t close.<\/p>\n<p>\u201cI didn\u2019t want a lawsuit. I went to the builder,\u201d he said. \u201cI showed him my problem; he said you have a major problem here.\u201d<\/p>\n<p>The builder called the engineer, but Walker said he never heard back from anyone. \u201cThat\u2019s why I needed a lawyer involved.\u201d<\/p>\n<p>Eventually, he said dozens of concrete piers had to be installed under the home to stabilize it.
