River Manor Condominium Association (4D12-901), the Fourth District reversed a trial court&#8217;s judgment entered after an appraisal award. In the appeal, Citizens argued &#8220;&#8230;that the final judgment improperly awarded the appellee\u00a0damages for: (a) property excluded under its policies, and (b) amounts that should have been deducted from the award by application of\u00a0defenses the trial court refused to consider.&#8221;<\/p>\n<p>The Fourth District agreed, at least with regard to the first part of Citizens argument. The Court&#8217;s twelve page opinion provides the details about the facts, arguments, and reasons for the holding. The ultimate conclusion is copied below:<\/p>\n<p>For the reasons discussed above, we reverse the trial court\u2019s final\u00a0judgment and remand this cause with directions that the trial court\u00a0enter a revised final judgment for the amounts set forth in the appraisal\u00a0award less:<\/p>\n<p>(i) amounts previously paid;<\/p>\n<p>(ii) amounts allocated to exterior common elements\u00a0excluded by the terms of the applicable insurance policies;\u00a0and<\/p>\n<p>(iii) amounts awarded in excess of any amount agreed\u00a0upon by the parties for roof repairs and water extraction for\u00a0Buildings A and C if, and only if, the trial court concludes \u2013\u00a0after an evidentiary hearing \u2013 that the parties reached a\u00a0binding pre-appraisal agreement stipulating to the amount\u00a0owed.<\/p>\n<p>To the extent the trial court refused to adjudicate Citizens\u2019 claims that\u00a0amounts awarded were duplicative or represent losses to property the\u00a0unit owners \u2013 as opposed to River Manor \u2013 were obligated to insure, the\u00a0judgment is affirmed.<\/p>\n<p>The opinion can be viewed HERE.<\/p>\n<p>via <a href=\"http:\/\/www.floridalegalblog.org\/2013\/04\/judgment-on-appraisal-award-reversed.html\">The Florida Legal Blog: Judgment On Appraisal Award Reversed Due To Coverage Issues<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jeffrey Kuntz &#8211; April 10, 2013 In Citizens Property Insurance Corporation v.
