Given the numbers alone, one can\u2019t help but wonder.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">Since the U.S. Supreme Court\u2019s 1999 decision in\u00a0<a style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; color: #7f007f; border-width: 0px; padding: 0px; margin: 0px;\" href=\"http:\/\/www.law.cornell.edu\/supct\/html\/97-1709.ZS.html\"><em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Kumho Tire Co. v. Carmichael<\/em><\/a>, which established that the criteria set forth in\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0applied to other types of expert testimony \u2013 not just that of a scientific nature \u2013 the number of\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges has risen sharply. While some increase may not be too surprising \u2013 after all, the\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Kumho<\/em>\u00a0decision expanded the pool of experts subject to\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0criteria \u2013 what has perhaps left experts and attorneys scratching their heads is the sheer increase in the number of challenges.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">According to a\u00a0<a style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; color: #7f007f; border-width: 0px; padding: 0px; margin: 0px;\" href=\"http:\/\/www.pwc.com\/us\/en\/forensic-services\/publications\/daubert-study-2010.jhtml\">PricewaterhouseCooper study<\/a>, which looked at\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges post\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Kumho<\/em>, the number of\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges to all expert witness types increased dramatically in the first decade of 2000. The study looked at federal courts and state courts utilizing\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0and revealed that\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges to all types of experts have exploded \u2013 in the year 2000 the study noted 253\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges, and that figure jumps to 879 in the year 2010 \u2013 amounting to an almost 350% increase. In fact, 2010 marked the year with the most<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges ever.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">As if those figures aren\u2019t daunting enough, 2010 showed a 49% success rate of\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\"><a href=\"http:\/\/www.expertwitnessinconstruction.com\/httpdocs\/news-The_Importance_of_Experts.php\">Daubert<\/a><\/em>\u00a0challenges to expert witnesses of all types, either in whole or part. The good news, if there is any, is that the percentage of successful challenges remained fairly stable over the first decade of 2000.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">The increase in\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges has occurred despite the fact that the number of filings, at least in federal court, has remained consistent over the same time period. For example, using information obtained from a website maintained by the\u00a0<a style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; color: #7f007f; border-width: 0px; padding: 0px; margin: 0px;\" href=\"http:\/\/www.uscourts.gov\/Statistics\/FederalJudicialCaseloadStatistics\/FederalJudicialCaseloadStatistics2001.aspx\">Administrative Office of the U.S. Courts<\/a>\u00a0which tracked a 12 month period ending March 31, the year 2001 saw 254,523 total civil cases filed in U.S. District Courts, compared to 282,307 cases filed in 2010. Although a slight increase in filings from 2001 to 2010 is noted, it is hardly in keeping with the almost 350% increase in\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenges measured using roughly the same time frame. U.S. Court of Appeals filings for that\u00a0<a style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; color: #7f007f; border-width: 0px; padding: 0px; margin: 0px;\" href=\"http:\/\/www.uscourts.gov\/Viewer.aspx?doc=\/uscourts\/Statistics\/FederalJudicialCaseloadStatistics\/2010\/front\/IndicatorsMar10.pdf\">same time period<\/a>\u00a0were also fairly stable \u2013 in 2001 there were 56,067 cases filed as compared to 56,790 in 2010.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">So what might all this mean?<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">Well, short of predicting the future, the huge increase in challenges alone makes it plausible that an expert witness retained for federal litigation or in a state that has adopted\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0may at some point be dealing with a\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenge.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">How does coming face to face with a\u00a0<a href=\"http:\/\/www.expertwitnessinconstruction.com\/httpdocs\/news-Daubert_Challenge.php\"><em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenge<\/a> affect an expert\u2019s future usability?<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">Failing a\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenge has the potential to be damaging to an expert. Whether a challenge is successful or not, once made, it\u2019s on the record and at minimum throws up a yellow flag for the attorney.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">That\u2019s in part because a\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0challenge goes to the very heart of the scientific methodology an expert uses to reach his or her conclusions \u2013 not to the actual conclusions reached \u2013 and therefore arguably has the greatest potential for\u00a0<a style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; color: #7f007f; border-width: 0px; padding: 0px; margin: 0px;\" href=\"http:\/\/experts.ims-expertservices.com\/expertlibrary\/2011\/ensuring-the-professional-and-financial-well-being-of-the-expert-witness\/\">lasting long-term harm<\/a>. Even more troubling is the fact that sometimes an expert isn\u2019t even aware that there was a challenge until well after the fact \u2013 after all, unlike the parties to an action, the expert witness has no true advocate or legal standing in the courtroom. He or she may not even find out about the challenge until after the case is settled or decided, and all the parties, attorneys, and other players in the courtroom have closed their briefcases and gone home.<\/p>\n<p style=\"margin-top: 0px; margin-right: 0px; margin-bottom: 1.5em; margin-left: 0px; border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; font-size: 14px; text-align: justify; font-family: Arial, Helvetica, sans-serif; line-height: 22px; background-color: #ffffff; border-width: 0px; padding: 0px;\">There is room for argument that, rather than as a method of raising the bar for scientific reliability,\u00a0<em style=\"border-style: initial; border-color: initial; border-image: initial; outline-width: 0px; outline-style: initial; outline-color: initial; border-width: 0px; padding: 0px; margin: 0px;\">Daubert<\/em>\u00a0is becoming a federal litigation rite of passage which may be subject to misuse, is scaring off experts, and is almost certainly increasing costs of litigation for everyone.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Maggie Tamburro &#8211; January 31, 2012 Are\u00a0Daubert\u00a0challenges really weeding out \u201cjunk science\u201d and \u201cpseudoscience\u201d in the courtroom, or could it be that they are actually scaring off good, competent experts?
