National Trust Ins. Co., Civil Action No.:7:14-cv-66-HL,\u00a0the U.S. District Court for the Middle District of Georgia\u00a0recently granted a\u00a0commercial\u00a0general liability insurer\u2019s motion to dismiss\u00a0a contractor\u2019s coverage action on the ground that\u00a0the policy\u2019s \u201cContractors\u00a0Errors and\u00a0Omissions\u201d\u00a0coverage\u00a0applied only to property damage to the contractors\u2019 work arising from\u00a0the contractor\u2019s own negligence, not that of its subcontractor.<\/p>\n<p>The contractor sought coverage for the costs it incurred to repair\u00a0damage to\u00a0a pool facility it was\u00a0hired to renovate. The contractor alleged that\u00a0the\u00a0damage to the pool and surrounding areas arose from the faulty workmanship of its subcontractor, which allegedly deviated from the design plan by failing to include essential parts and installing an improperly sized component.<\/p>\n<p>In relevant part, the subject policy\u2019s Contractors Errors and Omissions coverage applied to\u00a0\u201cproperty damage\u201d to the contractor\u2019s work \u201cdue to faulty workmanship, material or design\u2026.\u201d \u00a0However, in order for coverage to apply, the damages must have resulted from the contractor\u2019s negligent act, error or omission while acting in its\u00a0\u201cbusiness capacity as a contractor or subcontractor.\u201d\u00a0 The policy specifically exempted from this coverage \u201c[a]ny liability for \u2018property damage\u2019 to \u2018your work\u2019 if the damaged work or the work of which the damages arises was performed on your behalf by a subcontractor.\u201d<\/p>\n<p>The court ruled that the exemption prohibited the contractor\u2019s claim for coverage, which the court found to arise solely from the negligent work of its subcontractor. \u00a0The court rejected the\u00a0contractor\u2019s\u00a0argument that an exception to a policy exclusion, which appeared to extend coverage to damages arising out of work performed on the contractor\u2019s behalf by a subcontractor, demonstrated that coverage attached. \u00a0The court found that the more specific and limited language of the coverage grant prevailed over the more broadly inclusive language of the exception to the policy exclusion.<\/p>\n<p>via <a href=\"http:\/\/sedgwickinsurancelaw.com\/2014\/10\/07\/cannonball-cgl-policy-does-not-cover-pool-contractor-for-subcontractors-negligence\/\">Sedgwick Insurance Law Blog: Keeping You Updated on Significant Legal Issues Affecting the Insurance Industry \u00bb Blog Archive \u00bb Cannonball!
