An attorney and their expert witness<\/a> should have the same end goal in mind; they just walk on different sides of the fence to get to that goal.\u00a0 This list is to help you communicate as you walk along that fence and get the best out of your expert witness, and they in turn, can make you look great.<\/p>\n

1. <\/strong>Provide an unbiased overview of the case and understanding of the documents.<\/strong><\/p>\n

The problem, from an expert witness perspective, is we frequently receive a sketchy case briefing that is given with few facts, but with a heavy dose of emotional bias.\u00a0 Right or wrong, attorneys often give us the emotional side of the story and sell us on the unjust position that their client is in.\u00a0 Then with few facts in hand and after seeing only one side of the story, you then ask if we can help.\u00a0 Of course we can, we are anxious to help \u2013 and right off, our position is already tainted and biased.<\/em><\/p>\n

The solution: present facts \u2013 give both positions \u2013 pleadings are a good starting point.\u00a0 Question your expert.\u00a0 Encourage questions from your expert.\u00a0 Be open and then receptive to debate and healthy confrontation, good or bad, and then work together to find the best position for your client.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/em><\/p><\/blockquote>\n

2. Involving your expert early on quickly gives you the best information so that you can make the best decisions.<\/strong><\/p>\n

Go with the expert to the site; informally review the merit of the case to determine if it has substance.\u00a0 Consulting with an expert early has the potential of saving you both time and money.<\/em><\/p>\n

The problem, often we are brought in at the last minute and expected to perform miracles.\u00a0 If there is not enough time to properly evaluate documents, do site visits, and prepare, our testimony could be flawed resulting in an unfavorable judgment.<\/em><\/p>\n

Be cautious of experts who want to please \u2013 and give testimony according to what they think you want to hear.\u00a0 Do you want to risk your reputation and be blindsided during trial on the opinions and testimony of an expert who does not help you to understand the downside of your position?<\/em><\/p><\/blockquote>\n

3.<\/strong> We can provide you better results when we have a properly defined scope of our role.\u00a0<\/strong><\/p>\n

If a report is to be given, formalize as specifically as possible, in writing, the scope of expectations that you want your expert to perform.\u00a0 Help us to focus on what is important to you.<\/em><\/p><\/blockquote>\n

4. More success comes when adequate time is spent by attorney and expert together in preparation of deposition or trial testimony.<\/strong><\/p>\n

Role play with your expert, ask the questions that opposing counsel would ask.<\/em><\/p>\n

1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Get a feel for the testimony that will be given.<\/em>
\n2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Make sure that the expert understands the issues and is fighting the battles that count.<\/em>
\n3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Never presume you know what your expert is going to say. <\/em>
\n4.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ask \u201cHow would you respond to this or that question.\u201d<\/em>
\n5.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Challenge opinions.\u00a0 Ask for basis of opinion.\u00a0 Be sure that the expert can back up the opinion.\u00a0 Make sure that the experts opinion is based upon fact and is not coming from you.<\/em>
\n6.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Review how best to deal with hypothetical questions or \u201cwhat if\u201d questions that appear to lead to improper conclusions, or at least make it appear that it might be possible.<\/em>
\n7.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Review and discuss areas that you don\u2019t want your expert to get involved with. (A clearly defined scope of the issues you want the expert to focus on allows the expert to respond that he\/she wasn\u2019t asked to analyze\/review\/work on that, so at the moment, not prepared to discuss.)<\/em>
\n8.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Review documents that are helpful to the case, so that the expert can refresh recollection of documents.<\/em>
\n9.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Instruct your expert to \u201ctell the truth and give honest testimony.\u201d\u00a0 <\/em>
\na.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Gives the expert something to say when questioned about what was discussed in preparation meetings. <\/em>
\nb.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Gives you credibility with judge and jury \u2013 even though this action is expected.<\/em>
\n10.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Review the questions that you are going to ask and find out the reasoning behind the answer you receive.<\/em><\/p><\/blockquote>\n

The expert\u2019s role goes beyond helping you recognize a construction problem, standard of practice or estimate; it is also in giving you a clear cut understanding of the whys and wherefores of theconstruction defect<\/a>, the estimate, the building code violation or the detail related to the construction industry standard and practice.\u00a0 With proper information, knowledge and understanding, you will:<\/em><\/p>\n

i.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Be able to craft and ask the best questions\u00a0 to get helpful and favorable responses;<\/em>
\nii.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Know why you are asking the question.<\/em><\/p><\/blockquote>\n<\/blockquote>\n

5.<\/strong>\u00a0Whenever possible, allow your expert the opportunity to view opposing experts\u2019 testimony, depositions, reports, etc.<\/strong><\/p>\n

We can find holes, inaccuracies and unsupported facts, etc. that can be challenged in reports, pending depositions or rebuttal testimony.<\/em><\/p><\/blockquote>\n

6. Build credibility in your expert beyond qualifying the expert.<\/strong><\/p>\n

While seemingly obvious, encourage honesty, even if painful to your cause.<\/em><\/p>\n

Other tips to build credibility: avoid deception, half-truths and the perception of collusion, don\u2019t ask your expert to point finger of blame and keep expert from the appearance of being biased.<\/em><\/p><\/blockquote>\n

7.<\/strong>\u00a0Getting blindsided by new or otherwise not seen documentation makes us look foolish.<\/strong><\/em><\/p>\n

Provide documents timely so that they can be reviewed and we can help you properly prepare your case.<\/em><\/p><\/blockquote>\n

8.\u00a0Site inspections are a major key to get the full picture of the case.<\/strong><\/p>\n

When we inspect the site, we can often see other items of concern that haven\u2019t already been addressed.\u00a0 In contrast, it is difficult to sit on the stand and to have to respond to the question, \u201cHow can you possibly render that opinion, or present that estimate, when in fact you haven\u2019t even seen the project\/building\/home?\u201d<\/em><\/p><\/blockquote>\n

9.<\/strong> To improve testimony:<\/strong><\/p>\n

Review\/teach\/encourage your expert to look the jury and\/or the judge in the eyes when responding to questions.\u00a0 Have them speak up.\u00a0 If necessary, request that the question be repeated or rephrased if it is not understood or request that question be repeated to make sure it was heard correctly. \u00a0One final way to improve testimony<\/a> is to know that it is alright to say, I don\u2019t know.<\/em><\/p>\n

Remind your expert to be factual and accurate in statements. \u00a0Finally, review their report with them, and point out the areas you believe will be attacked and how to answer those attacks and ask the tough questions that might be asked.<\/em><\/p><\/blockquote>\n

10. Constructive feedback \u2013 is appreciated and will help the expert do a better job for you in the future.\u00a0<\/strong><\/p>\n

\u201cYou did a great job\u201d \u2013 is heard too often and not always justified.\u00a0 Allowing us an opportunity to receive specific comments that improve strengths and weaknesses for future testimony are appreciated.\u00a0 If we expect you to hear our honest opinion \u2013 good and bad – in your case, we want to hear your honest opinion on our testimony \u2013 good and bad.<\/em><\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"
