{"id":885893,"date":"2015-12-02T10:37:32","date_gmt":"2015-12-02T17:37:32","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=885893"},"modified":"2015-12-02T10:37:32","modified_gmt":"2015-12-02T17:37:32","slug":"connecticut-court-holds-no-cause-of-action-against-independent-adjuster-for-negligence","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/connecticut-court-holds-no-cause-of-action-against-independent-adjuster-for-negligence\/","title":{"rendered":"Connecticut Court Holds No Cause Of Action Against Independent Adjuster For Negligence"},"content":{"rendered":"<p>Dick Bennett | Property Insurance Law Observer | November 30, 2015<\/p>\n<p>The states are divided over whether an <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/california-insurance-adjusters-can-sued-negligent-misrepresentation\/\" target=\"_blank\">independent adjuster can be sued for negligence<\/a> by the insured, and no Connecticut appellate court has ever addressed that issue.\u00a0 Last Tuesday, however, one of the state\u2019s federal courts predicted that the Connecticut Supreme Court would hold that the adjuster owes no duty to the policyholder in <i>Danielsen v. USAA Cas. Ins. Co., et al.<\/i>, 2015 U.S. Dist. LEXIS 158387, 2015 WL 7458513 (Nov. 24, 2015, D. Conn.), and it dismissed the complaint\u2019s negligence count against the adjuster.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-1267\" src=\"http:\/\/propertyinsurancelawobserver.com\/wp-content\/uploads\/sites\/11\/2015\/11\/shutterstock_259947686-300x300.jpg\" alt=\"shutterstock_259947686\" width=\"168\" height=\"168\" \/>The insured owned a home in Madison that suffered water damage from a malfunctioning dishwasher, and he brought suit against the carrier and its <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/avoiding-property-adjusting-blunders\/\" target=\"_blank\">independent adjuster<\/a>, alleging that they had underpaid the loss.\u00a0 The allegations included negligence; the policyholder contended, inter alia, that the adjuster had prepared a negligent estimate and neglected to include damage to the homeowner\u2019s personal property in his scope of loss.\u00a0 The adjuster moved to dismiss the negligence count, and Judge Victor Bolden granted the motion on November 24th.<span id=\"more-1266\"><\/span><\/p>\n<p>The opinion began by noting that there was a split among state jurisdictions in this country over whether a cause of action for such negligence would lie against an <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/the-changing-face-of-independent-claims\/\" target=\"_blank\">independent adjuster<\/a>.\u00a0 The majority rule was that it would not.\u00a0 Judge Bolden then predicted that the Connecticut Supreme Court would side with the majority for three reasons.<\/p>\n<p>First, \u201c[t]he relationship between the adjuster and insured is sufficiently attenuated by the insurer\u2019s control over the adjuster to be an important factor that militates against imposing a further duty on the adjuster to the insured . . . The law of agency requires a duty of absolute loyalty of the adjuster to its employer, the insurer . . .
