{"id":885902,"date":"2015-12-02T12:05:23","date_gmt":"2015-12-02T19:05:23","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=885902"},"modified":"2015-12-02T12:05:23","modified_gmt":"2015-12-02T19:05:23","slug":"frye-vs-daubert-plaintiff-vs-defense","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/frye-vs-daubert-plaintiff-vs-defense\/","title":{"rendered":"Frye vs. Daubert = Plaintiff vs. Defense?"},"content":{"rendered":"<p>Annie Dike | IMS Expert Services\u00ae | November 23, 2015<\/p>\n<p>It\u2019s hard to decide if Florida is behind the times or just brilliant in its antiquated simplicity.\u00a0 While the entirety of the federal courts and the majority of states have adopted the <em>Daubert<\/em> standard for admission of expert testimony, Florida has for years remained seemingly content to follow <em><a href=\"https:\/\/www.myconstructionexpert.com\/blog\/daubert-frye-or-both-tracking-floridas-buy-in\/\" target=\"_blank\">Frye<\/a><\/em>.\u00a0 Whether you find this outdated or ingenious likely depends on whether you believe <em><a href=\"https:\/\/www.myconstructionexpert.com\/blog\/what-exactly-was-excluded-proffering-expert-opinions-to-preserve-daubertfrye-challenges\/\" target=\"_blank\">Daubert<\/a><\/em> is a more stringent standard or merely just a more detailed recitation of factors the courts were already considering under <em>Frye.\u00a0 <\/em>Your answer may also depend on whether you represent primarily plaintiffs or defendants.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft\" src=\"https:\/\/imsexpertservices.blob.core.windows.net\/cmsroot-appservices\/imsexpertservices\/media\/ims-media\/blog\/usa-florida.jpg\" alt=\"\" width=\"279\" height=\"219\" \/>It has been interesting to watch the debate develop among commentators, bar members, and various lobbying organizations within the Florida Bar over the Bar\u2019s upcoming December 4, 2015 recommendation to the Florida Supreme Court on whether to adopt the\u00a0<em>Daubert<\/em> standard as a rule of evidence.\u00a0 While the Legislature adopted the standard years ago (think side ponytails and high-top sneakers circa 1993) as the <em>procedure<\/em> for admission of <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/credibility-of-expert-witness-based-on-objectivity\/\" target=\"_blank\">expert testimony<\/a>, the Florida Supreme Court made it clear the statute could not stand as a rule of\u00a0<em>evidence<\/em> unless adopted by the court.\u00a0 That is the decision that now stands before the Court.\u00a0 Before making such an important decision, the Court sought input from the Bar and the Bar, in turn, sought input from its members.\u00a0 Hundreds of comments poured in from Florida lawyers, initiating a pretty heated debate and revealing a rather obvious split among the parties with the plaintiff\u2019s bar fighting strenuously for retention of <em>Frye<\/em> and the defense bar championing the <em>Daubert <\/em>standard.<\/p>\n<p>Has <em>Daubert<\/em> become such a tedious checklist for expert admissibility that it is used more often than not merely as a strategic device to fatigue plaintiff\u2019s counsel?\u00a0 Or, is the <em>Frye<\/em> standard such a loose line in the sand that it fosters the admission of unreliable expert testimony?\u00a0 With respect to the jury, does <em>Daubert<\/em> truly protect jurors from unaccepted, untested smoke-and-mirrors science, or is there any room to give the jury credit where credit is due, <em>i.e., <\/em>in that an attempt to offer testimony so outlandish should backfire.\u00a0 In theory, should the hard-fought and coveted trust of the jury serve sufficiently as its own <em>Daubert<\/em> standard without the need to deplete the resources of the courts, opposing counsel and clients with numerous, strenuous <em>Daubert <\/em>motions?\u00a0 <em>Or are you laughing at such a ludicrous proposition?<\/em>\u00a0 Either way, do you feel&#8230;<\/p>\n<p><a href=\"http:\/\/www.ims-expertservices.com\/bullseye\/november-2015\/frye-vs-daubert-plaintiff-vs-defense\/\" target=\"_blank\">To finish reading this article<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Annie Dike | IMS Expert Services\u00ae | November 23, 2015 It\u2019s hard to decide if Florida is behind the times or just brilliant in its antiquated simplicity.\u00a0 While the entirety of the federal courts and the majority of states have adopted the Daubert standard for admission of expert testimony, Florida has for years remained seemingly&hellip;
