{"id":886736,"date":"2016-02-02T16:58:21","date_gmt":"2016-02-02T23:58:21","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=886736"},"modified":"2016-02-02T16:58:21","modified_gmt":"2016-02-02T23:58:21","slug":"coverage-for-direct-physical-loss-does-not-necessarily-include-matching-or-require-aesthetic-uniformity","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/coverage-for-direct-physical-loss-does-not-necessarily-include-matching-or-require-aesthetic-uniformity\/","title":{"rendered":"Coverage for Direct Physical Loss Does Not Necessarily Include \u201cMatching\u201d or Require \u201cAesthetic Uniformity\u201d"},"content":{"rendered":"<p>Heidi Hudson Raschke | PropertyCasualtyFocus | January 29, 2016<\/p>\n<p>When a property insurance policy covers a multi-story building or multi-building property, and a portion sustains damage, there is often a question regarding the extent to which undamaged property should be replaced to ensure <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/florida-court-rejects-claim-replacement-of-undamaged-property-is-necessary-for-aesthetic-uniformity\/\" target=\"_blank\">matching and\/or aesthetic uniformity <\/a>throughout the property.\u00a0 In <em>Great American Insurance Company of New York v. The Towers of Quayside<\/em> No. 4 Condominium Association, 15-CV-20056 (S.D. Fla. Nov. 5, 2015)<a title=\"Great American Insurance Company of New York v. The Towers of Quayside No. 4 Condominium Association, 15-CV-20056 (S.D. Fla. Nov. 5, 2015),\" href=\"http:\/\/propertycasualtyfocus.com\/wp-content\/uploads\/2016\/01\/great-american-insurance-ny-v-towers-quayside.pdf\" target=\"_blank\">,<\/a> a District Court recently determined that the answer to this question is dependent on whether the requested repairs to undamaged property concern \u201cany continuous run of an item or adjoining area.\u201d<\/p>\n<h2>Quayside Gets a Wet Side<\/h2>\n<p>The insured property included a 25-story condominium building.\u00a0 In February 2013, a release of water from a broken valve on an air conditioning unit caused water damage to drywall, carpeting, baseboards, insulation, and wallpaper in the east hallways of floors one through eleven.\u00a0 Great American paid for the water damaged components on the east side of these floors, but Quayside asserted that repairing only what had sustained water damage did not fully compensate it for the <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/what-is-direct-physical-loss-that-results-from-a-covered-peril\/\" target=\"_blank\">direct physical loss<\/a> caused by the water damage.<\/p>\n<h2>Quayside Wants Coverage For the Dry Side<\/h2>\n<p>Floors three through twenty-five were designed to have a uniform appearance.\u00a0 The carpeted hallways of the east side of the building were separated from the carpeted west hallways by a tiled elevator lobby.\u00a0 \u201cQuayside sought coverage to repair or replace undamaged carpeting, wallpaper, baseboards, and woodwork in 1) the west hallways and elevator landings of the eleventh floor and floors below and 2) floors twelve through twenty-five. Quayside contend[ed] it is entitled to repair or replacement of these undamaged components because 1) it will otherwise not be possible to achieve aesthetic uniformity between the new carpeting, wallpaper, baseboards, and woodwork installed in the area that suffered water damage and the rest of the building and 2) the loss of aesthetic uniformity devalues the building and constitutes a loss to the building.\u201d<\/p>\n<p>The policy included a Difference in Conditions (\u201cDIC\u201d) Coverage Form that provided: \u201cWe will pay for your \u2018loss\u2019 to Covered Property from a Covered Cause of Loss.\u201d\u00a0 The policy defined \u201cCovered Cause of Loss\u201d as \u201cdirect physical \u2018loss\u2019 to Covered Property, except those causes of \u2018loss\u2019 listed in the exclusions.\u201d Through its Specified Cause of Loss Form, the policy excluded coverage for consequential loss, which it defined as \u201cDelay, loss of use, loss of market, or any other consequential loss.\u201d<\/p>\n<p>Great American moved for summary judgment seeking a declaration that Quayside is not entitled to coverage for replacement of undamaged building components.\u00a0 Quayside argued that \u201cthe measure of recovery under the policy must be determined from the perspective of damage to the building as a whole, that the building as a whole suffered direct physical damage from water, and that the policy covers all costs necessary to restore the building to its pre-loss, aesthetically uniform condition.\u201d<\/p>\n<h2>The Question Is Whether They Are Two Sides of a Continuous Run or Adjoining Area<\/h2>\n<p>The Court did not accept Quayside\u2019s argument that it is necessarily entitled to <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/minnesota-holds-comparable-material-quality-requires-wholesale-replacement-undamaged-siding-faded\/\" target=\"_blank\">matching<\/a> or aesthetic uniformity, stating \u201cthe policy plainly only provides coverage for \u2018direct physical loss,\u2019 specifically excludes coverage for consequential loss, and makes no mention of \u2018matching\u2019 or \u2018aesthetic uniformity\u2019 at all.\u201d\u00a0 However, the Court held that \u201ccoverage for matching, for the purpose of achieving aesthetic uniformity, is appropriate where repairs concern \u2018any continuous run of an item or adjoining area\u2019 for materials such as wallpaper, baseboards, woodwork, and carpeting, [but] it is plain that matching is not otherwise required under the policy.\u201d\u00a0 (Quoting <em>Ocean View Towers Ass\u2019n, Inc. v. QBE Ins. Corp.<\/em>, No. 11-60447, 2011 WL 6754063, at *12 n.4 (S.D. Fla.
