{"id":886966,"date":"2016-02-09T17:07:27","date_gmt":"2016-02-10T00:07:27","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=886966"},"modified":"2016-02-09T17:07:27","modified_gmt":"2016-02-10T00:07:27","slug":"common-sense-prevails-state-of-collapse-nonexistent-thirteen-years-before-discovery-of-decay","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/common-sense-prevails-state-of-collapse-nonexistent-thirteen-years-before-discovery-of-decay\/","title":{"rendered":"Common Sense Prevails: State of Collapse Nonexistent Thirteen Years before Discovery of Decay"},"content":{"rendered":"<p>Craig Bennion | Property Insurance Law Observer | February 8, 2016<\/p>\n<p>For years, property insurance policies that exclude rot damage have been called upon to <img decoding=\"async\" class=\"alignright\" src=\"http:\/\/propertyinsurancelawobserver.com\/wp-content\/uploads\/sites\/11\/2016\/02\/shutterstock_309231059-300x200.jpg\" alt=\"shutterstock_309231059\" \/>cover rot because the policies extend coverage to <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/court-defines-collapse\/\" target=\"_blank\">\u201ccollapse\u201d<\/a>\u2014an undefined term\u2014caused by hidden decay, even if the structure remains standing and in use.<\/p>\n<p>The Homeowners Association of the Queen Anne Park Condominium in Seattle discovered decay within the walls of its buildings in 2011. State Farm insured the Association with policies effective between 1992 and 1998. The policies excluded coverage for rot, but covered <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/costs-incurred-to-repair-property-other-than-insureds-defective-work-itself-are-covered-damages\/\" target=\"_blank\">\u201ccollapse\u201d<\/a> caused by hidden decay. The Association argued that its buildings were in a state of collapse in or before 1998 and that State Farm covered the decay damage. State Farm denied the claim and the Association sued in federal court in Washington. The trial court granted summary judgment to State Farm and the Association appealed to the Ninth Circuit Court of Appeals.<\/p>\n<p>Finding the meaning of \u201ccollapse\u201d undefined in the policies and in Washington law, the Ninth Circuit certified the question of its meaning to the Washington Supreme Court. In <i>Queen Anne Park Homeowners Ass\u2019n v. State Farm Fire &amp; Cas. Co.,<\/i> 183 Wn.2d 485, 352 P.3d 790 (2015), the Washington court held that \u201ccollapse\u201d means a \u201csubstantial impairment of the structural integrity of a building or part of a building that renders such building or part of a building unfit for its function or unsafe.\u201d The collapse must be \u201cmore than mere settling, cracking, shrinkage, bulging, or expansion.\u201d 352 P.3d at 794. It issued its decision, favorable to State Farm, on February 3, 2016. <i>Queen Anne Park Homeowners Ass\u2019n v. State Farm Fire &amp; Cas. Co.,<\/i> No. 12-36021, 2016 WL 424736 (9<sup>th<\/sup> Cir. 2\/3\/2016).<\/p>\n<p>The lower court had applied an \u201cimminent danger\u201d standard to evaluate \u201ccollapse,\u201d not the \u201csubstantial impairment of structural integrity\u201d test adopted by the Washington Supreme Court.
