Eckler LLP | February 12, 2016<\/p>\n<p>Risk is the fertile soil upon which compromise grows.\u00a0In order to most effectively mediate a construction matter, the <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/mediators-moment-obstacles-to-successful-mediation\/\" target=\"_blank\">mediator<\/a> must be able to convince the parties of their risk, both with regard to the outcome at trial and with regard to the costs associated with preparing for, and trying, the case.<\/p>\n<p>Parties to a construction dispute are unlikely to be swayed by the mediator\u2019s evaluation of risk if the <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/getting-beyond-emotion-in-mediation\/\" target=\"_blank\">mediator<\/a> is ignorant of the language of the industry.\u00a0Even a glimmer of ignorance of terms such as RFI (Request for Information), resource loaded critical path schedule, change order, soil compaction\/organic soil issues, shop drawings and submittals, weather delays\u00a0and the like will cause experienced construction professionals to question the quality of the mediator\u2019s risk assessment and leave them thinking that the mediator\u2019s assessment of their case is flawed (<em>i.e.<\/em>, the mediator would see that we are going to win if she\/he just understood construction.)<\/p>\n<p>Equally important, the <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/another-reason-to-love-construction-mediation-read-why-mediation-works\/\" target=\"_blank\">mediator<\/a> should have experience actually trying construction cases.\u00a0The time and cost associated with trying a construction case can only be credibly evaluated by someone who can demonstrate that they have done it.\u00a0Moreover, any experienced construction litigator will likely come armed with stories of cases that they should have lost but, in fact, won, and cases that they thought were slam dunks that they, in fact, lost (this assumes that the mediator is sufficiently humble to admit to having lost, a somewhat rare characteristic in litigators).\u00a0The mediator may also have stories of cases that were won at the trial court level only to have been reversed on appeal.<\/p>\n<p>In short, there is no substitute for knowledge and experience when it comes to selecting an effective construction mediator.\u00a0If the parties\u00a0are going to go to&#8230;<\/p>\n<p><a href=\"http:\/\/www.lexology.com\/library\/detail.aspx?g=149e7238-1a83-4b83-a1b8-60b765a4b7e2&amp;utm_source=Lexology+Daily+Newsfeed&amp;utm_medium=HTML+email+-+Body+-+General+section&amp;utm_campaign=Lexology+subscriber+daily+feed&amp;utm_content=Lexology+Daily+Newsfeed+2016-02-16&amp;utm_term=\" target=\"_blank\">To finish reading this article<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jack Rosati, Jr. | Bricker &amp;
