{"id":891991,"date":"2017-04-20T10:33:23","date_gmt":"2017-04-20T16:33:23","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=891991"},"modified":"2017-04-20T10:33:23","modified_gmt":"2017-04-20T16:33:23","slug":"dear-engineer-has-your-insurer-issued-a-reservation-of-rights-letter-law-note","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/dear-engineer-has-your-insurer-issued-a-reservation-of-rights-letter-law-note\/","title":{"rendered":"Dear Engineer: Has your Insurer Issued a \u201cReservation of Rights\u201d Letter?"},"content":{"rendered":"<p>Melissa Dewey Brumback | <a href=\"http:\/\/constructionlawnc.com\/2017\/04\/17\/dear-engineer-ror\/\" target=\"_blank\">Construction Law in North Carolina<\/a> | April 17, 2017<\/p>\n<p>In my previous post, I made reference to getting a \u00a0\u201c<strong>Reservation of Rights<\/strong>\u201d letter.\u00a0\u00a0 I noted that the carrier may decide to defend you under a Reservation of Rights (i.e., hire your lawyer) but may not, necessarily,\u00a0accept the responsibility for paying\u00a0the claim.\u00a0 <strong>Does this mean that the insurance company has denied your claim, or will never pay?<\/strong>\u00a0 No.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-4934\" src=\"https:\/\/i0.wp.com\/constructionlawnc.com\/bwh-wp\/wp-content\/uploads\/2017\/04\/opening-letter.jpg?resize=243%2C233\" sizes=\"auto, (max-width: 243px) 100vw, 243px\" srcset=\"https:\/\/i0.wp.com\/constructionlawnc.com\/bwh-wp\/wp-content\/uploads\/2017\/04\/opening-letter.jpg?resize=300%2C288 300w, https:\/\/i0.wp.com\/constructionlawnc.com\/bwh-wp\/wp-content\/uploads\/2017\/04\/opening-letter.jpg?resize=150%2C144 150w, https:\/\/i0.wp.com\/constructionlawnc.com\/bwh-wp\/wp-content\/uploads\/2017\/04\/opening-letter.jpg?w=625 625w\" alt=\"\" width=\"243\" height=\"233\" \/><\/p>\n<p>Reservation of Rights (ROR) letters are sent for a variety of reasons- most notably, when\u00a0some portion of the construction lawsuit against you is not covered under your E&amp;O policy.\u00a0 The letter must state the reason(s) that the ROR is being issued.<\/p>\n<p>With the ROR, the insurance company is telling you that <strong>it reserves the right to withdraw from your defense and\/or deny payment of damages at a later date<\/strong>, depending upon how facts in the case develop.\u00a0 The notice is intended to let you know that <strong>there *may* be issues later<\/strong>, and to put you notice that\u00a0 you have the right to hire your own lawyer (at your own expense) to protect yourself from that future potential risk.<\/p>\n<p><strong>How should you react to getting a ROR letter<\/strong>?\u00a0 You should review it with your own lawyer, and\u00a0consider retaining\u00a0your lawyer to work with the lawyer the insurance carrier retains to protect your rights.<\/p>\n<p>Is this required?\u00a0 No.\u00a0 <strong>Your insurance-retained lawyer still owes you the duty to protect your interests<\/strong>.\u00a0 If the insurance company decides to later withdraw from defense, or seek a court ruling that they do not owe you a defense, your insurance-provided lawyer <strong>cannot represent the insurance company against you.<\/strong>\u00a0 The insurance company would need to hire a different lawyer\/law firm to make that argument.<\/p>\n<p>It is never pleasant to get a ROR letter, but it is not unusual, depending on the particular facts in your case.\u00a0 And it doesn\u2019t mean that you won\u2019t have a vigorous defense, or that the insurance-retained lawyer is not working for you.\u00a0 They are, and they will.\u00a0 However, it is never bad advise to have your own personal lawyer weigh in on the ROR letter and its ramifications for your Firm.<\/p>\n<p><strong>Have you ever gotten a ROR letter from your insurance carrier?\u00a0 If so, share in the comment section, below.\u00a0 And, be sure to get your White Paper on 7 Critical Mistakes that Architects &amp;
