Ralph Gage Contracting Inc., the Kjellanders sued Gage after he inspected a house they wanted to buy and gave it a positive report.\u00a0 The Kjellanders claimed the house had mold and a bad HVAC system, and they wouldn\u2019t have bought it if they had known about the problems \u2014 which the inspector should have discovered.\u00a0 But since the inspection did not <em><strong>cause <\/strong><\/em>the property damage, Gage\u2019s insurance did not cover the claimed loss.<\/p>\n<blockquote><p>Under the terms of the Policy, Auto-Owners agreed to pay \u201csums that the insured becomes legally obligated to pay as damages because of \u2018bodily injury\u2019 or \u2018property damage\u2019 to which this insurance applies.\u201d In pertinent part, the Policy provided coverage for \u201cproperty damage\u201d only if it was \u201ccaused by an \u2018occurrence.\u2019\u201d The Policy defines \u201cproperty damage\u201d this way:<\/p>\n<p>a. Physical injury to tangible property, including all resulting loss of use of that property. All such loss of use shall be deemed to occur at the time of the physical injury that caused it; or<br \/>\nb. Loss of use of tangible property that is not physically injured. All such loss of use shall be deemed to occur at the time of the \u201coccurrence\u201d that caused it.<\/p>\n<p>An \u201coccurrence\u201d is defined as \u201can accident, including continuous or repeated exposure to substantially the same general harmful conditions.\u201d In a case like this one \u2014 where the term \u201caccident\u201d is undefined by the Policy \u2014 the Florida Supreme Court has said that \u201caccident\u201d means \u201cnot only \u2018accidental events,\u2019 but also damages or injuries that are neither expected nor intended from the viewpoint of the insured.\u201d<\/p>\n<p>The plain language of the Policy requires unambiguously a causal link between the alleged \u201cproperty damage\u201d and an \u201coccurrence.\u201d Here, the only asserted \u201coccurrence\u201d is Gage\u2019s alleged negligent inspection. Thus, to show that their claim is within the Policy\u2019s coverage, the Kjellanders must demonstrate that Gage\u2019s negligent inspection caused \u201cproperty damage\u201d within the meaning of the Policy.<\/p><\/blockquote>\n<p>The property was damaged before the inspection, not because of the inspection.\u00a0 Thus, there was no coverage for the loss.
