{"id":892920,"date":"2017-09-20T14:30:22","date_gmt":"2017-09-20T20:30:22","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=892920"},"modified":"2017-09-20T14:30:22","modified_gmt":"2017-09-20T20:30:22","slug":"colorado-statutory-bad-faith-doubling-insurers-unreasonable-delay-denial","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/colorado-statutory-bad-faith-doubling-insurers-unreasonable-delay-denial\/","title":{"rendered":"Colorado Statutory Bad Faith: Doubling Down On An Insurer\u2019s Unreasonable Delay Or Denial"},"content":{"rendered":"<p>Jonathan Bukowski | <a href=\"http:\/\/www.propertyinsurancecoveragelaw.com\/2017\/08\/articles\/bad-faith\/colorado-statutory-bad-faith-doubling-down-on-an-insurers-unreasonable-delay-or-denial\/\" target=\"_blank\">Property Insurance Coverage Law Blog<\/a> | August 19, 2017<\/p>\n<section class=\"post-content\">In August 2008, Colorado created a statutory bad faith claim of action for first-party policyholders not only separate and distinct from a claim for common law bad faith breach of an insurance contract, but establishes a much more reasonable threshold to prevail against an insurer under\u00a0Colorado Revised Statute \u00a7 10-3-1115\u00a0and\u00a0Colorado Revised Statute \u00a7 10-3-1116.<\/p>\n<p>Most importantly, the statute provides significant recourse for a successful policyholder in the form of:<\/p>\n<ul>\n<li>Two times the\u00a0<em><strong>covered benefit<\/strong><\/em>,<\/li>\n<li>attorneys\u2019 fees, and<\/li>\n<li>court costs<\/li>\n<\/ul>\n<p>To bring a claim for statutory bad faith under \u00a7 10-3-1115 and \u00a7 10-3-1116, the party(s) asserting the claim must have\u00a0<em><strong>entitlement to benefits owed directly<\/strong><\/em>\u00a0to or on behalf of an insured\u00a0<em><strong>under an insurance policy<\/strong><\/em>. However, this does not include any nonparticipating provider performing services or a person asserting a claim against an insured under a liability policy.<\/p>\n<p>Finally, the party asserting the claim must establish:<\/p>\n<ol>\n<li>The insurer delayed\u00a0<em><strong>or<\/strong><\/em>\u00a0denied authorizing payment of a covered benefit,\u00a0<em><strong>and<\/strong><\/em><\/li>\n<li>the insurer had no reasonable basis for delaying\u00a0<em><strong>or<\/strong><\/em>\u00a0denying the covered benefit.<\/li>\n<\/ol>\n<p>Colorado Revised Statute \u00a7 10-3-1116 does not require proof of actual damages. Rather, a policyholder\u2019s recovery is determined by the amount of the \u201ccovered benefit\u201d in dispute.
