{"id":893871,"date":"2018-03-29T11:14:59","date_gmt":"2018-03-29T17:14:59","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=893871"},"modified":"2018-03-29T11:14:59","modified_gmt":"2018-03-29T17:14:59","slug":"negligence-construction-manager-agent","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/negligence-construction-manager-agent\/","title":{"rendered":"Negligence Against a Construction Manager-Agent"},"content":{"rendered":"<p>David Adelstein | <a href=\"http:\/\/www.floridaconstructionlegalupdates.com\/negligence-against-a-construction-manager-agent\/\" target=\"_blank\" rel=\"noopener\">Florida Construction Legal Updates<\/a> | March 9, 2018<\/p>\n<p>Can a\u00a0<strong>construction manager-agent<\/strong>\u00a0\/ owner\u2019s representative hired directly by the owner be liable to the general contractor in\u00a0<strong>negligence<\/strong>? \u00a0An argument likely posited by many general contractors on projects gone awry where there is a separate construction manager. \u00a0Well, here is an interesting case out of Louisiana that supports a\u00a0<strong>negligence claim<\/strong>\u00a0against a construction manager-agent.<\/p>\n<p>&nbsp;<\/p>\n<p>In\u00a0<i>Lathan Company, Inc. v. State, Department of Education, Recovery School District<\/i>, 2017 WL 6032333 (La.App. 1<sup>st<\/sup>\u00a0Cir. 2017), a general contractor entered into a contract with a public owner to renovate a school.\u00a0 The public owner hired a separate construction manager (as the owner\u2019s agent) for the project.\u00a0 The general contractor claimed that the construction manager was negligent through its: unreasonable refusal to approve payment applications; delayed responses to submittals and questions; refusal to recommend substantial completion; refusal to properly manage construction oversight; and its interference with the progress of the project.\u00a0\u00a0 The contractor claimed, in particular, that given the scope of the construction manager\u2019s supervisory and management responsibilities for the project, the construction manager owed a duty to exercise its responsibilities in a professional manner (akin to a professional negligence claim). \u00a0These factual assertions are not unusual facts asserted by a general contractor on a problematic project with a separate construction manager \/ owner\u2019s representative.<\/p>\n<p>&nbsp;<\/p>\n<p>The trial court granted summary judgment in favor of the construction manager on the negligence claim. But, the appellate court reversed finding that the construction manager did owe a duty to the general contractor:<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Accordingly, after careful review of the record herein, we find that although Jacobs [construction manager] was not in direct contractual privity with Lathan [contractor], Jacobs must be deemed and held to know that its services were not only for the protection or interests of\u00a0the owner but also third parties, including, specifically, Lathan, who was acting as the general contractor on the project. As outlined above, it was foreseeable and to a degree certain that Lathan would suffer economic harm if Jacobs failed to perform, or negligently performed, many of its\u00a0professional duties<\/strong>.\u00a0 Moreover, as outlined above, there is a close connection between Jacobs\u2019s alleged failure to act according to industry standards, and the alleged economic harm suffered by Lathan.<\/p>\n<p>***<\/p>\n<p><strong>Thus, after carefully considering the record herein, and applying the balancing test enunciated in the jurisprudence noted above, we are unable to find any reason why the courts\u2019 rationale in such prior jurisprudence, extending the liability of architects and engineers, should not likewise apply to a project management professional, under the facts of this case<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><i>Lathan Company, supra<\/i>, at *13-14 (internal citations omitted).<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>David Adelstein | Florida Construction Legal Updates | March 9, 2018 Can a\u00a0construction manager-agent\u00a0\/ owner\u2019s representative hired directly by the owner be liable to the general contractor in\u00a0negligence? \u00a0An argument likely posited by many general contractors on projects gone awry where there is a separate construction manager. \u00a0Well, here is an interesting case out of&hellip;
