The ambiguity in this case arose both from lexicographers\u2019 habit of capturing nuances in writing dictionary definitions of \u201cdecay,\u201d and the insurer\u2019s own choice to use different words for supposedly the same meaning.<\/p>\n\n\n\n<p>In\u00a0<em>Feenix Parkside LLC v. Berkley North Pacific<\/em>, the insured\u2019s roof had collapsed after the building\u2019s trusses failed, but without any evidence of dry rot or similar \u201cdecay\u201d weakening them. Under the policy, a collapse caused by \u201cdecay that is hidden from view\u201d is covered, but collapse from other causes, such as defective construction (but without some accompanying decay), was excluded. Relying on the first definition of decay that would first come to mind for most insureds in the Pacific Northwest, Berkley denied the claim because its adjusters did not find any \u201caerobic decomposition of proteins chiefly by bacteria.\u201d<\/p>\n\n\n\n<p>Not so fast, said the court. Although decay in the context of damage to a building (and, perhaps, especially one in rainy Auburn, Washington just south of Seattle) might naturally imply dry rot, the dictionary definitions are not so limited. In particular, several versions of Webster\u2019s dictionaries included some variant of \u201cdecay\u201d to mean \u201cthe condition of a person or thing that has undergone a decline in strength, soundness, or prosperity or has been diminished in degree of excellence or perfection.\u201d Webster\u2019s usage example for this meaning is \u201cthe&nbsp;<em>decay<\/em>of the public school system.\u201d<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft\"><img decoding=\"async\" src=\"https:\/\/www.thepolicyholderreport.com\/wp-content\/uploads\/sites\/268\/2019\/04\/decay-mug-320x276.jpg\" alt=\"\" class=\"wp-image-2170\"\/><\/figure><\/div>\n\n\n\n<p>This shaded difference in meaning, driven by the\u00a0<em>context<\/em>\u00a0of how \u201cdecay\u201d is being used, may have tipped the scales in favor of Berkley\u2019s proposed, and coverage-defeating, definition. One does not usually speak of the \u201cdecline in strength\u201d of a damaged building, after all, but of rotted framing. But that is not how policy interpretation works in insurance-coverage disputes. Washington, like Oregon, favors any genuine ambiguity in favor of the insured. And because Berkley\u2019s adjusters had found a \u201cdecline in strength\u201d of the roof trusses caused by \u201chigher than normal temperatures,\u201d which then gave way in the collapse, the insured got the checkered flag. No rot required.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.thepolicyholderreport.com\/wp-content\/uploads\/sites\/268\/2019\/04\/mug2.jpg\" alt=\"\" width=\"386\" height=\"332\"\/><\/figure><\/div>\n\n\n\n<p>Winning coverage was also possible because of ambiguity in how Berkley itself described these issues in different parts of its policy.
