Amendment to Section 558.004, Florida Statutes"},"content":{"rendered":"\n<p>William Linero, Jr. | <a href=\"https:\/\/www.butler.legal\/lights-camera-not-an-action-amendment-to-section-558004-florida-statutes\">Butler Weihmuller Katz Craig <\/a>| June 14, 2019<\/p>\n\n\n\n<p>On July 1, 2019, Chapter 558, Florida Statutes, will be amended to add section\u00a0558.004(1)(d), which states:\u00a0 \u201cA notice of claim served pursuant to this chapter shall not toll any statute of repose period under chapter 95.\u201d<a href=\"https:\/\/www.butler.legal\/lights-camera-not-an-action-amendment-to-section-558004-florida-statutes#_edn1\">[1]<\/a>\u00a0 In adding 558.004(1)(d), it appears that the Florida Legislature is attempting to correct last year\u2019s ruling from the Fourth District Court of Appeals in\u00a0<em>Gindel v. Centex<\/em>.<a href=\"https:\/\/www.butler.legal\/lights-camera-not-an-action-amendment-to-section-558004-florida-statutes#_edn2\">[2]<\/a><\/p>\n\n\n\n<p><em>Gindel\u00a0<\/em>held that a claimant\u2019s service of a notice of claim alleging a construction defect under Chapter 558, Florida Statutes, constitutes commencement of \u201can action\u201d for the purpose of satisfying Florida\u2019s ten year statute of repose under Florida Statute\u00a095.11(3)(c).<a href=\"https:\/\/www.butler.legal\/lights-camera-not-an-action-amendment-to-section-558004-florida-statutes#_edn3\">[3]<\/a>.\u00a0 Accordingly, as was the case in\u00a0<em>Gindel<\/em>, if a claimant serves a statutory notice of claim prior to the expiration of the statute of repose, a subsequent lawsuit filed by the claimant is not time-barred, even if the lawsuit is filed after the expiration of the statute of repose period.<a href=\"https:\/\/www.butler.legal\/lights-camera-not-an-action-amendment-to-section-558004-florida-statutes#_edn4\">[4]<\/a>\u00a0 This would appear to render any tolling argument moot.\u00a0 However, continuing to follow\u00a0<em>Gindel\u00a0<\/em>would conversely appear to render the added language in 558.004(1)(d) meaningless, as service of a notice of claim in and of itself would constitute an action, eliminating any necessity for tolling.\u00a0<\/p>\n\n\n\n<p>While 558.004(1)(d) does not specifically state that a notice of claim of a construction defect does not constitute&nbsp;an action under Chapter 95, providing that a notice of claim does not toll the statute of repose period appears to effectively accomplish the same end.&nbsp; It should be interesting to see how this issue is addressed by Florida courts going forward.&nbsp;<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><a href=\"https:\/\/www.butler.legal\/lights-camera-not-an-action-amendment-to-section-558004-florida-statutes#_ednref1\">[1]<\/a>\u00a0Florida Chapter 2019-75,CS\/CS\/HB 447<\/p>\n\n\n\n<p><a href=\"https:\/\/www.butler.legal\/lights-camera-not-an-action-amendment-to-section-558004-florida-statutes#_ednref2\">[2]<\/a>&nbsp;<em>Gindel v.
