State Farm Lloyds<\/em>,<sup>1<\/sup>\u00a0and\u00a0<em>Ortiz v. State Farm Lloyds<\/em>.<sup>2<\/sup>\u00a0The specific issue in these two decisions was what effect did an insurer\u2019s full and timely payment of an appraisal award have on the insured\u2019s various causes of actions and damages?<\/p>\n\n\n\n<p>The answer to that issue was found to depend on the particular cause of action analyzed. In&nbsp;<em>Barbara Technologies<\/em>, the Texas high court held that following an insurer\u2019s payment of an appraisal award, an insured can still pursue a violation for delay in payment under Chapter 542 of the Texas Prompt Payment of Claims Act (\u201cTPPCA\u201d).<sup>3<\/sup>&nbsp;In&nbsp;<em>Ortiz<\/em>, the court held that an insurance company\u2019s payment of an appraisal award bars the insured\u2019s breach of contract claim and the insured\u2019s common law and statutory bad faith claims to the extent that the only actual damages sought are lost policy benefits.<sup>4<\/sup><\/p>\n\n\n\n<p>Recently, in light of\u00a0<em>Barbara Technologies<\/em>, a Federal Southern District trial court granted a reconsideration in\u00a0<em>Shin v. Allstate Texas Lloyds<\/em>.<sup>5<\/sup>\u00a0There, the trial court had granted summary judgment on plaintiff\u2019s Prompt Payment Act claim on the ground that under Texas law, \u201cfull and timely payment of an appraisal award under the policy precludes an award of penalties under the Insurance Code\u2019s prompt payment provisions as a matter of law.\u201d<sup>6<\/sup>\u00a0That ruling in\u00a0<em>Shin<\/em>\u00a0preceded\u00a0<em>Barbara Technologies<\/em>\u00a0by just a couple of days which again, as noted above, held that an insurer\u2019s payment of the appraisal award did not foreclose TPPCA damages.<sup>7<\/sup>\u00a0In granting the reconsideration, the court requested supplemental briefing on two issues: whether the\u00a0<em><strong>\u201creasonableness\u201d exception<\/strong><\/em>\u00a0in\u00a0<em>Mainali Corp. v. Covington Specialty Insurance Company<\/em>,<sup>8<\/sup>\u00a0survived\u00a0<em>Barbara Technologies<\/em>; and, in particular to the\u00a0<em>Shin<\/em>\u00a0case, whether the initial payment before appraisal \u2014 pre-appraisal payment \u2014 was \u201creasonable.\u201d<\/p>\n\n\n\n<p>In&nbsp;<em>Mainali<\/em>, the Fifth Circuit Court of Appeals held that there is no statutory violation of the Prompt Payment Act&nbsp;<em><strong>if<\/strong><\/em>&nbsp;the insurer\u2019s pre-appraisal payment was \u201creasonable.\u201d The pre-appraisal amount in&nbsp;<em>Mainali<\/em>&nbsp;was found to be undeniable reasonable because it exceeded the appraisal award amount found by the appraisal panel. Finding that&nbsp;<em>Barbara Technologies<\/em>&nbsp;actually cited&nbsp;<em>Mainali<\/em>&nbsp;with approval, and therefore,&nbsp;<em>Mainali<\/em>&nbsp;had not been overruled, the court in reconsideration in&nbsp;<em>Shin<\/em>&nbsp;held; reading the two cases in conjunction with each other, they stand for the proposition of law that to avoid a Prompt Payment Act violation, an insurer must have made a \u201creasonable\u201d pre-appraisal payment within the statutorily-provided period.<sup>9<\/sup><\/p>\n\n\n\n<p>Applying the above, the court in&nbsp;<em>Shin<\/em>&nbsp;looked at the appraisal award amount of $25,944.94 which was 5.6 times greater than the initial pre-appraisal payment of $4,616.63, but nonetheless, found that the pre-appraisal payment was \u201creasonable\u201d for two reasons.<sup>10<\/sup>&nbsp;<strong>First<\/strong>, Allstate had complied with the Prompt Payment Act requirements of responding to the claim and requesting additional information, evaluating and investigating the claim.&nbsp;<strong>Second<\/strong>, the difference between Allstate\u2019s pre-appraisal and appraisal payments was no larger than the difference in other cases in which courts had made a similar \u201creasonableness\u201d finding.<sup>11<\/sup>&nbsp;Based on this analysis, the court in&nbsp;<em>Shin<\/em>&nbsp;affirmed its prior ruling of granting summary judgment for Allstate on Plaintiff\u2019s Prompt Payment Act claim.<\/p>\n\n\n\n<p>After&nbsp;<em>Shin<\/em>, the answer to the title question of&nbsp;<strong>\u201cAfter Payment of an Appraisal Award: Is there More?\u201d<\/strong>&nbsp;is a \u201cmaybe\u201d under the Prompt Payment Act depending on how each individual court determines or finds \u201creasonableness\u201d of the pre-appraisal payment.<\/p>\n\n\n\n<p>A new question, however, that may follow this holding is: Will insurers outright deny claims for a zero-pre-appraisal payment which under\u00a0<em>Shin<\/em>, no doubt, would be found to be \u201cunreasonable\u201d when compared to any amount of an appraisal award and thereby subject insurers to possible violations under the Prompt Payment Act\u00a0<em><strong>or<\/strong><\/em>\u00a0will insurers low-ball pre-appraisal payments, move for appraisal, and roll-the-dice on \u201creasonableness\u201d?
