{"id":896691,"date":"2019-11-12T10:02:15","date_gmt":"2019-11-12T17:02:15","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=896691"},"modified":"2019-11-12T10:02:19","modified_gmt":"2019-11-12T17:02:19","slug":"admissability-of-expert-opinion-insurance-bad-faith-trials","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/admissability-of-expert-opinion-insurance-bad-faith-trials\/","title":{"rendered":"Admissibility of Expert Opinions in Insurance Bad Faith Trials"},"content":{"rendered":"\n<p>David McLain | <a href=\"http:\/\/www.coloradoconstructionlitigation.com\/2019\/10\/admissibility-of-expert-opinions-in.html\">Colorado Construction Litigation<\/a>| October 8, 2019<\/p>\n\n\n\n<p> In 2010, Hansen Construction was sued for construction defects and was defended by three separate insurance carriers pursuant to various primary CGL insurance policies.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn1\">[i]<\/a>\u00a0\u00a0One of Hansen\u2019s primary carriers, Maxum Indemnity Company, issued two primary policies, one from 2006-2007 and one from 2007-2008.\u00a0\u00a0Everest National Insurance Company issued a single excess liability policy for the 2007-2008 policy year, and which was to drop down and provide additional coverage should the 2007-2008 Maxum policy become exhausted.\u00a0\u00a0In November 2010, Maxum denied coverage under its 2007-2008 primarily policy but agreed to defend under the 2006-2007 primarily policy.\u00a0\u00a0When Maxum denied coverage under its 2007-2008 primary policy, Everest National Insurance denied under its excess liability policy.\u00a0<\/p>\n\n\n\n<p>In 2016, pursuant to a settlement agreement between Hansen Construction and Maxum, Maxum retroactively reallocated funds it owed to Hansen Construction from the 2006-2007 Maxum primary policy to the 2007-2008 Maxum primary policy, which became exhausted by the payment.\u00a0\u00a0Thereafter, Hansen Construction demanded coverage from Everest National, which continued to deny the claim.\u00a0\u00a0Hansen Construction then sued Everest National for, among other things, bad faith breach of contract.<\/p>\n\n\n\n<p>In the bad faith action, both parties retained experts to testify at trial regarding insurance industry standards of care and whether Everest National\u2019s conduct in handling Hansen Construction\u2019s claim was reasonable.\u00a0\u00a0Both parties sought to strike the other\u2019s expert testimony as improper and inadmissible under Federal Rule of Evidence 702.<br>In striking both sides\u2019 expert opinions, the U.S. District Court Judge Christine Arguello set forth the standards for the admissibility of expert opinions in Federal Court:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Under\u00a0Daubert, the trial court acts as a \u201cgatekeeper\u201d by reviewing a proffered expert opinion for relevance pursuant to\u00a0Federal Rule of Evidence 401, and reliability pursuant to\u00a0Federal Rule of Evidence 702.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn2\">[ii]<\/a>\u00a0 The proponent of the expert must demonstrate by a preponderance of the evidence that the expert\u2019s testimony and opinion are admissible.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn3\">[iii]<\/a>\u00a0 This Court has discretion to evaluate whether an expert is helpful, qualified, and reliable under\u00a0Rule 702.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn4\">[iv]<\/a><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Federal Rule of Evidence 702\u00a0governs the admissibility of expert testimony.\u00a0Rule 702\u00a0provides that a witness who is qualified as an expert by \u201cknowledge, skill, experience, training, or education\u201d may testify if:<br>(a) the expert\u2019s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;<\/p><p>(b) the testimony is based on sufficient facts or data;<\/p><p>(c) the testimony is the product of reliable principles and methods; and<\/p><p>(d) the expert has reliably applied the principles and methods to the facts of the case.<br>Fed. R. Evid. 702.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>In deciding whether expert testimony is admissible, the Court must make multiple determinations. First, it must first determine whether the expert is qualified \u201cby knowledge, skill, experience, training, or education\u201d to render an opinion.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn5\">[v]<\/a>\u00a0 Second, if the expert is sufficiently qualified, the Court must determine whether the proposed testimony is sufficiently \u201crelevant to the task at hand,\u201d such that it \u201clogically advances a material aspect of the case.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn6\">[vi]<\/a>\u00a0 \u201cDoubts about whether an expert\u2019s testimony will be useful should generally be resolved in favor of admissibility unless there are strong factors such as time or surprise favoring exclusions.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn7\">[vii]<\/a><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Third, the Court examines whether the expert\u2019s opinion \u201chas \u2018a reliable basis in the knowledge and experience of his [or her] discipline.\u2019\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn8\">[viii]<\/a>\u00a0 In determining reliability, a district court must decide \u201cwhether the reasoning or methodology underlying the testimony is scientifically valid.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn9\">[ix]<\/a>\u00a0 In making this determination, a court may consider: \u201c(1) whether a theory has been or can be tested or falsified, (2) whether the theory or technique has been subject to peer review and publication, (3) whether there are known or potential rates of error with regard to specific techniques, and (4) whether the theory or approach has general acceptance.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn10\">[x]<\/a><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>The Supreme Court has made clear that this list is neither definitive nor exhaustive.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn11\">[xi]<\/a>\u00a0 In short, \u201c[p]roposed testimony must be supported by appropriate validation\u2014i.e., \u2018good grounds,\u2019 based on what is known.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn12\">[xii]<\/a><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>The requirement that testimony must be reliable does\u00a0<strong>not<\/strong>\u00a0mean that the party offering such testimony must prove \u201cthat the expert is indisputably correct.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn13\">[xiii]<\/a>\u00a0 Rather, the party need only prove that \u201cthe method employed by the expert in reaching the conclusion is scientifically sound and that the opinion is based on facts which sufficiently satisfy\u00a0Rule 702\u2019s reliability requirements.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn14\">[xiv]<\/a>\u00a0\u00a0Guided by these principles, this Court has \u201cbroad discretion\u201d to evaluate whether an expert is helpful, qualified, and reliable under the \u201cflexible\u201d standard of\u00a0Fed. R. Evid. 702.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn15\">[xv]<\/a><\/p><\/blockquote>\n\n\n\n<p>With respect to helpfulness of expert opinions, Judge Arguello explained:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Federal Rule of Evidence 704 allows an expert witness to testify about an ultimate question of fact.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn16\">[xvi]<\/a>\u00a0 To be admissible, however, an expert\u2019s testimony must be helpful to the trier of fact.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn17\">[xvii]<\/a>\u00a0\u00a0To ensure testimony is helpful, \u201c[a]n expert may not state legal conclusions drawn by applying the law to the facts, but an expert may refer to the law in expressing his or her opinion.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn18\">[xviii]<\/a><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cThe line between a permissible opinion on an ultimate issue and an impermissible legal conclusion is not always easy to discern.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn19\">[xix]<\/a>\u00a0 Permissible testimony provides the jury with the \u201ctools to evaluate an expert\u2019s ultimate conclusion and focuses on questions of fact that are amenable to the scientific, technical, or other specialized knowledge within the expert\u2019s field.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn20\">[xx]<\/a><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>However, \u201can expert may not simply tell the jury what result it should reach&#8230;.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn21\">[xxi]<\/a>\u00a0 Further, \u201cexpert testimony is not admissible to inform the trier of fact as to the law that it will be instructed to apply to the facts in deciding the case.\u201d<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn22\">[xxii]<\/a>\u00a0\u00a0Similarly, contract interpretation is not a proper subject for expert testimony.<a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_edn23\">[xxiii]<\/a><\/p><\/blockquote>\n\n\n\n<p>Finding that all three of the experts intended to offer opinions that were objectionable on the basis of helpfulness, Judge Arguello granted both parties\u2019 motions to exclude the expert testimony of the opposing experts.\u00a0<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><a href=\"file:\/\/hhmr-server\/HHMR_Law\/Administrative\/Blog%20Entries%20&amp;%20Articles\/Admissibility%20of%20Expert%20Opinions%20in%20Insurance%20Bad%20Faith%20Trials.docx#_ednref1\">[i]<\/a>\u00a0Hansen Construction, Inc. v.
