{"id":897079,"date":"2020-02-18T15:38:51","date_gmt":"2020-02-18T22:38:51","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=897079"},"modified":"2020-02-18T15:38:55","modified_gmt":"2020-02-18T22:38:55","slug":"appreciate-risks-assuming-in-contract","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/appreciate-risks-assuming-in-contract\/","title":{"rendered":"Appreciate the Risks you are Assuming in your Contract"},"content":{"rendered":"\n<p>David Adelstein | <a href=\"https:\/\/www.floridaconstructionlegalupdates.com\/appreciate-risks-you-are-assuming\/\">Florida Construction Legal Updates<\/a><\/p>\n\n\n\n<p><strong>APPRECIATE THE RISKS YOU ARE ASSUMING IN YOUR CONTRACT<\/strong>. &nbsp;&nbsp;Otherwise, those risks will come back and bite you in the butt. &nbsp;This language is not capitalized for naught. &nbsp;Regardless of the type of contract you are entering into, there are risks you will be assuming. &nbsp;You need to appreciate those risks because there may be insurance you can obtain to cover that risk.<\/p>\n\n\n\n<p>For instance,&nbsp;<strong>exculpatory provisions<\/strong>&nbsp;(or get-out-of-jail provisions) in contracts are enforceable if they are unambiguous.&nbsp; \u201c<strong>Such provisions are deemed to be unambiguous and enforceable when the language unequivocally demonstrates a clear and understandable intention for the defendant to be relieved from liability such that an ordinary and knowledgeable person will know what he or she is contracting away<\/strong>.\u201d&nbsp;&nbsp;<em>Pillay v.
