{"id":897450,"date":"2020-05-12T11:28:01","date_gmt":"2020-05-12T17:28:01","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=897450"},"modified":"2020-05-12T11:28:05","modified_gmt":"2020-05-12T17:28:05","slug":"georgia-addresses-statute-of-repose","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/georgia-addresses-statute-of-repose\/","title":{"rendered":"Georgia House Bill Addresses Construction Statute of Repose"},"content":{"rendered":"\n<p>Jason Gropper | <a rel=\"noreferrer noopener\" href=\"https:\/\/ahclaw.com\/construction-blog-posts\/2020\/03\/georgia-house-bill-addresses-construction-statute-of-repose\/\" target=\"_blank\">Autry, Hall &amp; Cook<\/a><\/p>\n\n\n\n<p>On March 2, 2020, by a unanimous vote,&nbsp;the House passed HB&nbsp;968.&nbsp; This&nbsp;Bill&nbsp;seeks&nbsp;to&nbsp;clarify which&nbsp;civil&nbsp;actions&nbsp;are subject to&nbsp;Code Section 9-3-51,&nbsp;which is the&nbsp;eight-year&nbsp;statute of repose for&nbsp;deficiencies in connection with improvements&nbsp;to realty.&nbsp;&nbsp;If passed by the General Assembly,&nbsp;it would explicitly state that&nbsp;the statute of repose will not apply to breach of express warranties.&nbsp;&nbsp;If the Bill is passed, O.C.G.A&nbsp;\u00a7&nbsp;9-3-51&nbsp;would include&nbsp;a&nbsp;subsection&nbsp;that&nbsp;provides:&nbsp;\u201cThis Code section shall not apply to actions for breach of contract, including, but not limited to actions for breach of express contractual warranties.\u201d&nbsp;<\/p>\n\n\n\n<p>This Bill\u00a0arises\u00a0from the October 2019 Court of Appeals decision in\u00a0<em>Southern States Chemical v. Tampa Tank<\/em>, which we covered\u00a0in a\u00a0<a href=\"https:\/\/ahclaw.com\/construction-blog-posts\/2019\/12\/2185\/\">prior post<\/a><em>.\u00a0\u00a0<\/em>Southern States argued the statute of repose did not apply to claims for breach of express\u00a0warranty,\u00a0especially\u00a0to long-term\u00a0warranties\u00a0that\u00a0extend\u00a0well\u00a0beyond the eight-year statute of repose.\u00a0 The Court of Appeals did not\u00a0agree and, instead,\u00a0held that when a\u00a0statute\u2019s\u00a0text is clear and unambiguous, the court will apply the plain meaning.\u00a0\u00a0Therefore, the court declared that the claims of Southern State were barred under O.C.G.A \u00a7 9-3-51(a).\u00a0 HB 968 seeks to\u00a0negate\u00a0this court ruling.\u00a0\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jason Gropper | Autry, Hall &amp;
