Boucher | <a rel=\"noreferrer noopener\" href=\"https:\/\/www.saul.com\/blogs\/construction-industry-counselor\/us-eighth-circuit-court-appeals-holds-no-cgl-insurance\" target=\"_blank\">Saul Ewing Arnstein &amp; Lehr<\/a><\/p>\n\n\n\n<p>On May 12, 2020, the United States Eight Circuit Court of Appeals, applying Missouri law, rejected a contractor\u2019s contention that its <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/commercial-general-liability-insurance-exclusions-worth-close-examination\/\" target=\"_blank\" rel=\"noreferrer noopener\">commercial general liability<\/a> (CGL) policy provided coverage for claims arising out of the contractor\u2019s allegedly <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/federal-court-reaffirms-no-duty-defend-indemnify-builder-defective-construction-work\/\" target=\"_blank\" rel=\"noreferrer noopener\">defective construction work<\/a>. See\u00a0<em>Am. Family Mut. Ins. Co., S.I. v. Mid-Am. Grain Distributors, LLC<\/em>, No. 19-2050, 2020 WL 2373986 (8th Cir. May 12, 2020). The court\u2019s decision affirmed the lower court\u2019s summary judgment decision in favor of the insurer.<\/p>\n\n\n\n<p>Contractor Mid-American Grain Distributors, LLC (\u201cMid-American\u201d) sought a defense and indemnification under its CGL policy issued by American Family Mutual Insurance Company (the \u201cInsurer\u201d) in response to claims in a lawsuit alleging damages arising from \u201cdesign and construction issues.\u201d However, the CGL policy only provided coverage for an occurrence, which was defined as an accident under the policy. Under Missouri law, an accident is determined by examining whether \u201cthe insured foresaw or expected the injury or damages\u201d and does not include \u201cacts that result in expected or foreseeable damages.\u201d<\/p>\n\n\n\n<p>Reasoning that damages resulting from shoddy workmanship are foreseeable, the appellate court ruled that there was no \u201caccident\u201d to trigger a defense or indemnification for Mid-American. This case serves as a reminder to owners and contractors alike that a contractor\u2019s insurance policy often does not provide coverage for damages resulting from the contractor\u2019s defective or shoddy work.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gregory M.
