But\u00a0<strong>Cooley\u2019s Litigation Chair Michael Attanasio<\/strong>\u00a0says there are more problems with a <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/virtual-jury-trials\/\" target=\"_blank\" rel=\"noreferrer noopener\">virtual jury trial<\/a> to be skeptical about.<\/p>\n\n\n\n<p>Attanasio said one of the constitutional issues that remote jury trials could raise is that defendants didn\u2019t get a jury of their peers, because every person must have a steady WiFi connection.<\/p>\n\n\n\n<p><strong>\u201cYou\u2019re creating a class of jurors who happen to have secure internet connections and nice computers,\u201d<\/strong>&nbsp;Cooley said. \u201cI don\u2019t think that\u2019s very workable either. That\u2019s a real issue. It\u2019s not unlike the debate about how schools are being managed and conducted right now with these challenges and the difference between socioeconomic groups when it comes to remote learning. You would have the same thing with remote court, and that\u2019s not how juries are supposed to be constructed.\u201d<\/p>\n\n\n\n<p>The San Diego partner said the trials could raise challenges based on the U.S. Supreme Court\u2019s&nbsp;<em>Batson<\/em>&nbsp;decision, which spoke to the principal that jury service is a right as a citizen.<\/p>\n\n\n\n<p>\u201cSo you are taking the right to be a juror and you are excluding the class of people who don\u2019t have computers and internet connections that would allow them to be in court on a screen for five or six hours a day,\u201d he said. \u201cThat raises some real interesting issues.\u201d<\/p>\n\n\n\n<p>Keep an eye on your\u00a0<strong>Legal Speak podcast<\/strong>\u00a0feeds for the full interview with Attanasio to find out the Cooley litigation team\u2019s quarantine ritual for staying sharp amid trial backlogs.
