C. English and RKK had no more to give (after all, there have been posts with wisdom from this case\u00a0<a href=\"https:\/\/www.myconstructionexpert.com\/blog\/wp-admin\/post.php?post=895858&amp;action=edit\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>,\u00a0<a href=\"https:\/\/www.myconstructionexpert.com\/blog\/wp-admin\/post.php?post=896480&amp;action=edit\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>, and\u00a0<a href=\"https:\/\/www.myconstructionexpert.com\/blog\/wp-admin\/post.php?post=896480&amp;action=edit\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>), it keeps on giving.\u00a0 A\u00a0<a href=\"https:\/\/constructionlawva.com\/wp-content\/uploads\/2021\/04\/W.-C.-English-v-RKK.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">relatively recent opinion from this litigation<\/a>\u00a0involved, among other pre-trial motions, motions by English to exclude <a href=\"http:\/\/adviseandconsult.net\/experts.php\" target=\"_blank\" rel=\"noreferrer noopener\">expert witness testimony<\/a>.\u00a0 English sought to exclude Defendant CDM Smith, Inc\u2019s expert testimony relating to CDM\u2019s standard of care, the replacement of the bridge deck, English\u2019s failure to fire CDM, and additional contributing factors regarding the spacing of the reinforcing steel.\u00a0 English sought to exclude RKK\u2019s expert opinion regarding English\u2019s owed standard of care vis a vis VDOT.<\/p>\n\n\n\n<p>In evaluating these motions, the Court applied the following standard:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>An expert qualified \u201cby knowledge, skill, experience, training, or education, may testify \u201cas to scientific, technical, or other specialized knowledge if it will assist the trier of fact. However, such testimony is only admissible if (1) \u201cthe testimony is based upon sufficient facts or data,\u201d (2) \u201cthe testimony is the product of reliable principles and methods,\u201d and (3) \u201cthe expert has reliably applied the principles and methods to the facts of the case.\u201d [citations excluded here but stated in the opinion]<\/p><\/blockquote>\n\n\n\n<p>In applying this standard, the Court partially granted the motion to exclude CDM\u2019s expert.&nbsp; The Court found that the expert\u2019s experience was adequate and his opinion met the three-part test above as to the first of his opinions on standard of care.&nbsp; However, the Court excluded the last three opinions for various reasons from lack of helpfulness to the jury to simply reading documents and providing his legal conclusion.&nbsp; The Court excluded RKK\u2019s expert from testifying because he would simply be providing his interpretation of certain specific parts of the factual record and such interpretation is generally the province of the jury.<\/p>\n\n\n\n<p>This opinion provides a good overview of some of the expert witness issues that can arise in a commercial construction matter.\u00a0 Construction professionals and\u00a0their attorneys here in Virginia\u00a0should review this case as well as those it cites when evaluating the usefulness of certain expert opinions in presenting their claims in litigation.\u00a0 I highly recommend the opinion to your reading.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Christopher G.
