Gone is Governor\u2019s Stay at Home Executive Order. Gone is California\u2019s Blueprint for a Safer Economy. And gone is the state\u2019s somewhat confusing four-tier, yellow (minimal), orange (moderate), red (substantial) and purple (widespread), risk-level mapping system.&nbsp;<\/p>\n\n\n\n<p>So what does this mean for the construction industry?<\/p>\n\n\n\n<p>Well it\u2019s not quite business back to usual. CalOSHA\u2019s Standards Board voted this past Thursday to pass revised COVID-19\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__nomosllp.us20.list-2Dmanage.com_track_click-3Fu-3D7899711f3e3ff3a2c445fa947-26id-3D5c8850164d-26e-3Db209e49623&amp;d=DwMFaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=x8sV9WXqG_mNN5zo0tiqHi4OceqWygrJaHlIfvydno8&amp;m=VKMqkEOB-otfvucFXxJCr8-aQJpafZmNYZcQ0JJvK-k&amp;s=gX64IK_j4_08xLNShOeZs7_XCx9NRhJFAs0nTx7lJCQ&amp;e=\" target=\"_blank\" rel=\"noreferrer noopener\">Emergency Temporary Standards<\/a>\u00a0(\u201cRevised Standards\u201d). That same day, Governor Newsom signed\u00a0Executive Order N-09-21\u00a0implementing the Revised Standards\u00a0<strong><u>immediately<\/u><\/strong>\u00a0while they are being reviewed by the Office of Administrative Law.<\/p>\n\n\n\n<p><strong>When Do the Revised Standards Take Effect?<\/strong><\/p>\n\n\n\n<p>The Revised&nbsp;Standards take effect immediately,&nbsp;although they are subject to review by the Office of Administrative Law, so there could be changes in&nbsp;the future<strong>.<\/strong><\/p>\n\n\n\n<p><strong>Who Do the Revised Standards Apply to?<\/strong><\/p>\n\n\n\n<p>The Revised Standards apply to all employers in California.<\/p>\n\n\n\n<p><strong>What are the Requirements Under the Revised Standards?<\/strong><\/p>\n\n\n\n<p>The Revised Standards include the following requirements:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Face Coverings:<\/strong>\u00a0\u00a0Workers without COVID-19 symptoms, whether indoors or outdoors and irrespective of vaccination status, will no longer be required to wear face coverings except in the case of an outbreak\u00a0(<em>i.e.<\/em>, 3 or more cases in an exposed group of employees), and in certain settings when\u00a0required by the California Department of Public Health\u00a0(CDPH), such as public transit, K-12 educational facilities, etc..\u00a0<\/li><li><strong>Respirators:<\/strong>\u00a0Employers are required to provide\u00a0respirators for voluntary use to all workers who are not fully vaccinated and who are working indoors or in vehicles with more than one (1) person and to all workers, irrespective of vaccination status,\u00a0during a major outbreak (<em>i.e.<\/em>, 20 or more cases in an exposed group of employees). Respirators must be a respiratory device approved by the National Institute of Occupational Safety and Health (NIOSH) to protect the wearer from particulate matter, such as an N95 filtering facepiece respirator.<\/li><li><strong>Physical Distancing:<\/strong>\u00a0Physical distancing and\u00a0barriers are no longer required. However, employers are to evaluate whether to implement physical distancing and barriers during an outbreak, and during a major outbreak, employers must implement physical distancing and barriers.<\/li><li><strong>Cleaning Procedures:<\/strong>\u00a0Employers are required to continue\u00a0identifying and regularly cleaning frequently touched surfaces and objects.\u00a0Employer are required to\u00a0inform employees and authorized employee representatives of cleaning and disinfection protocols\u00a0including the planned frequency and scope of cleaning and disinfecting.<\/li><li><strong>COVID-19 Prevention Program:<\/strong>\u00a0Employers are still required to maintain a written COVID-19 Prevention Program. However, employers must now review the \u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__nomosllp.us20.list-2Dmanage.com_track_click-3Fu-3D7899711f3e3ff3a2c445fa947-26id-3D7c69609f57-26e-3Db209e49623&amp;d=DwMFaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=x8sV9WXqG_mNN5zo0tiqHi4OceqWygrJaHlIfvydno8&amp;m=VKMqkEOB-otfvucFXxJCr8-aQJpafZmNYZcQ0JJvK-k&amp;s=pS3DY0PZbhttiLpCep8_dHGFYEEtrDulS_8BaxhzolI&amp;e=\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">CDPH\u2019s Interim Guidance\u00a0for Ventilation, Filtration, and Air Quality in Indoor Environments<\/a>. COVID-19 prevention training must also include information on how the vaccine is effective at preventing COVID-19 and protecting against both transmission and serious illness or death.<\/li><li><strong>Exclusion from the Workplace:\u00a0<\/strong>Fully vaccinated workers who do not have COVID-19 symptoms no longer need to be excluded from the workplace after a close contact (<em>i.e.<\/em>, within six (6) feet of a COVID-19 case for a cumulative total of\u00a015 minutes or more during any 24-hour).<\/li><\/ul>\n\n\n\n<p><strong>Where Can I Get Further Information?<\/strong><\/p>\n\n\n\n<p>CalOSHA has published a&nbsp;<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__nomosllp.us20.list-2Dmanage.com_track_click-3Fu-3D7899711f3e3ff3a2c445fa947-26id-3Dd2ad83f383-26e-3Db209e49623&amp;d=DwMFaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=x8sV9WXqG_mNN5zo0tiqHi4OceqWygrJaHlIfvydno8&amp;m=VKMqkEOB-otfvucFXxJCr8-aQJpafZmNYZcQ0JJvK-k&amp;s=Yky3-0Cbl8sDOZAxn6XAX46Exk9T4_sVuE-NJVqwAfg&amp;e=\" target=\"_blank\" rel=\"noreferrer noopener\">FAQ<\/a>&nbsp;on the&nbsp;Revised Standards.
