{"id":899018,"date":"2021-08-11T15:51:00","date_gmt":"2021-08-11T21:51:00","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=899018"},"modified":"2021-08-06T16:04:24","modified_gmt":"2021-08-06T22:04:24","slug":"appraisal-videotape-permitted","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/appraisal-videotape-permitted\/","title":{"rendered":"Policyholder Permitted to Videotape Appraisal"},"content":{"rendered":"\n<p>Maria Louise (Ria) Cousineau | <a href=\"https:\/\/www.propertyinsurancelawobserver.com\/2021\/07\/30\/policyholder-permitted-to-videotape-appraisal\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Property Insurance Law Observer<\/a><\/p>\n\n\n\n<p>In\u00a0<em>Silversmith v State Farm Insurance Company<\/em>, 2021 W.L. 2910240 (Fla. 4th DCA July 7, 2021), Florida\u2019s Fourth District Court of Appeal ruled that policyholders may openly videotape an inspection by the insurance company appraiser, despite the state\u2019s \u201ctwo-party consent law.\u201d The court held that an <a href=\"http:\/\/www.adviseandconsult.net\/experts.php\" target=\"_blank\" rel=\"noreferrer noopener\">appraiser<\/a> has \u201cno legitimate expectation of privacy while in the insured\u2019s home for the inspection.\u201d\u00a0<em>Silversmith v State Farm<\/em>, 2021 WL 291040, p.1.\u00a0<\/p>\n\n\n\n<p>The facts revealed that the insurer invoked the appraisal clause on a property loss, and the policyholder sought to videotape the appraisal. The insurer\u2019s appraiser objected on privacy grounds.&nbsp; The policyholder filed an action seeking permission to videotape the appraisal of her home, and the trial court refused.&nbsp; Relying on Section 934.03 Florida Statutes 2020 (the two-party consent rule), the trial court denied the request, ruling, \u201cno one may audio\/video record the inspection unless all participants consent.\u201d&nbsp;<em>Id<\/em>.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/www.propertyinsurancelawobserver.com\/wp-content\/uploads\/sites\/11\/2021\/07\/shutterstock_555184183.jpg\"><img decoding=\"async\" src=\"https:\/\/www.propertyinsurancelawobserver.com\/wp-content\/uploads\/sites\/11\/2021\/07\/shutterstock_555184183.jpg\" alt=\"\" class=\"wp-image-1837\"\/><\/a><\/figure>\n\n\n\n<p>On appeal, the Fourth District Court of Appeal reversed the trial court and held (1) \u201cnothing in the policy precluded [the videotaping] of an appraisal inspection,\u201d and (2) the insurer\u2019s appraiser \u201chas no legitimate expectation of privacy while in the insured\u2019s home for the inspection.\u201d &nbsp;The appellate Court reversed the trial court order and remanded the case for further proceedings.<\/p>\n\n\n\n<p>Does this mean an insurer can videotape the inspection conducted by the insured\u2019s appraiser?&nbsp; Not on the plain language of this decision. The court decided this case on a legitimate expectation of privacy in the insured\u2019s home.&nbsp; The court found the insurance company\u2019s appraiser did not have one; the question remains whether a court will hold the insured\u2019s own appraiser to this same privacy standard. &nbsp;&nbsp;
