The more involved and protracted the litigation, the more your company must reallocate its resources (i.e.&nbsp;time and money) to tend to the litigation instead of focusing on&nbsp;projects&nbsp;that generate&nbsp;revenue.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Despite the headache,\u00a0litigation\u00a0serves a\u00a0necessary\u00a0purpose\u00a0to\u00a0protect\u00a0what owners and their employees have built.\u00a0However, going to court is not always\u00a0the\u00a0best\u00a0or\u00a0even the\u00a0most economical\u00a0method\u00a0of\u00a0litigation; enter <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/arbitration-vs-litigation-5-issues-to-consider\/\" target=\"_blank\" rel=\"noreferrer noopener\">arbitration<\/a>.\u00a0<\/p>\n\n\n\n<p><strong>What Is&nbsp;Arbitration?<\/strong>&nbsp;<\/p>\n\n\n\n<p>In short, arbitration&nbsp;is&nbsp;a&nbsp;mechanism that allows&nbsp;parties to resolve&nbsp;their&nbsp;dispute&nbsp;outside of the&nbsp;court system&nbsp;through a&nbsp;neutral&nbsp;arbitrator selected by the parties.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Arbitration of disputes&nbsp;will occur&nbsp;only&nbsp;if the parties have agreed to arbitrate&nbsp;in writing. In the construction industry,&nbsp;many contracts include&nbsp;arbitration&nbsp;clauses that predetermine&nbsp;the parties\u2019 arbitration rights&nbsp;prior to&nbsp;any&nbsp;dispute.&nbsp;As such,&nbsp;whether drafting or executing a contract,&nbsp;construction professionals should weigh certain considerations&nbsp;before&nbsp;committing to arbitration of potential disputes.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>What are the Benefits of Arbitration?<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Efficiency<\/strong>&nbsp;\u2013&nbsp;Strict,&nbsp;drawn-out&nbsp;procedural&nbsp;timelines&nbsp;and&nbsp;a judge\u2019s&nbsp;need to tend&nbsp;to a vast number of&nbsp;other&nbsp;cases&nbsp;can result in&nbsp;court proceedings&nbsp;going unresolved for years.&nbsp;Arbitration&nbsp;offers a far&nbsp;more streamlined&nbsp;approach&nbsp;and allows&nbsp;the parties to&nbsp;quickly&nbsp;schedule&nbsp;when&nbsp;they will&nbsp;resolve their dispute.&nbsp;<\/li><li><strong>Choice of&nbsp;Arbitrator&nbsp;<\/strong>\u2013&nbsp;In court,&nbsp;a&nbsp;judge is assigned to a case&nbsp;with&nbsp;an&nbsp;extremely limited&nbsp;ability to object by&nbsp;the parties. However,&nbsp;arbitration allows the parties to&nbsp;mutually&nbsp;select their arbitrator.&nbsp;This is particularly beneficial in the construction context, as the parties can select an arbitrator familiar with the specific type of&nbsp;construction&nbsp;dispute at issue.&nbsp;<\/li><li><strong>Cost<\/strong>&nbsp;\u2013&nbsp;The&nbsp;speed&nbsp;at which&nbsp;the parties can schedule&nbsp;and conduct&nbsp;an&nbsp;arbitration&nbsp;means&nbsp;they&nbsp;can&nbsp;often&nbsp;bypass&nbsp;some of&nbsp;the costs associated with conducting discovery&nbsp;and&nbsp;exchanging motions&nbsp;synonymous with&nbsp;court&nbsp;proceedings. This typically&nbsp;translates into&nbsp;the attorney billing&nbsp;less&nbsp;time&nbsp;and&nbsp;a significant reduction in&nbsp;overall&nbsp;cost.&nbsp;<\/li><li><strong>Finality<\/strong>&nbsp;\u2013&nbsp;When a judge&nbsp;decides a case, the non-prevailing&nbsp;party has&nbsp;a&nbsp;right to seek an appeal of that&nbsp;decision.&nbsp;Appeals&nbsp;significantly increase the&nbsp;time&nbsp;and cost&nbsp;of&nbsp;litigation.&nbsp;Decisions of the&nbsp;arbitrator,&nbsp;on the other hand,&nbsp;are final&nbsp;and not appealable.&nbsp;There are very limited grounds for asking a court to vacate an arbitration award.&nbsp;In other words, the arbitrator has the final say&nbsp;in deciding the dispute, period.&nbsp;<\/li><li><strong>Confidentiality<\/strong>&nbsp;\u2013&nbsp;Construction professionals, like many&nbsp;service-oriented&nbsp;industries,&nbsp;are&nbsp;established&nbsp;and&nbsp;knocked down&nbsp;by&nbsp;their&nbsp;reputation.&nbsp;Disputes&nbsp;can result in damaging allegations that, if filed in court, become public record&nbsp;for anyone to view.&nbsp;Arbitration,&nbsp;however, is&nbsp;confidential&nbsp;and&nbsp;allows the parties to freely&nbsp;explore&nbsp;the&nbsp;dispute&nbsp;without&nbsp;outward&nbsp;scrutiny.&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<p><strong>What are the Disadvantages of Arbitration?<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Finality<\/strong>\u00a0\u2013\u00a0As mentioned above, the arbitrator\u2019s word on the matter is final. As such,\u00a0a\u00a0party\u00a0that feels aggrieved by the\u00a0arbitrator\u2019s\u00a0decision\u00a0often\u00a0has no other recourse and\u00a0must live\u00a0with\u00a0it.\u00a0<\/li><li><strong>Unpredictable Decisions<\/strong>\u00a0\u2013\u00a0Arbitration uses much less stringent rules for evidence. As such, unfavorable evidence that\u00a0would\u00a0otherwise\u00a0be\u00a0kept out of\u00a0court\u00a0may be permitted in arbitration.\u00a0Also, because arbitration skips many of the fact-finding procedures\u00a0of\u00a0litigation,\u00a0parties\u00a0may\u00a0be unable\u00a0to gather all the\u00a0evidence\u00a0needed to\u00a0support\u00a0their\u00a0position before arbitration.\u00a0\u00a0<\/li><li><strong>Cost<\/strong>\u00a0\u2013\u00a0Yes, <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/arbitration-vs-litigation-the-great-debate\/\" target=\"_blank\" rel=\"noreferrer noopener\">arbitration is\u00a0<em>generally<\/em>\u00a0more cost-effective than litigation<\/a>. However,\u00a0there are exceptions. Litigation\u00a0requires that the\u00a0parties\u00a0pay\u00a0their\u00a0costs and attorneys\u2019 fees.\u00a0Arbitration, in addition to those costs,\u00a0requires that the\u00a0parties\u00a0also\u00a0pay\u00a0the arbitrator for their services.\u00a0Arbitrators set their rates, and\u00a0the cost of\u00a0highly\u00a0specialized arbitrators\u00a0can balloon quickly.\u00a0As such,\u00a0the parties should exercise caution in choosing an arbitrator\u00a0that\u00a0will fairly judge the\u00a0case but\u00a0will\u00a0also resolve the dispute\u00a0cost-effectively.\u00a0\u00a0<\/li><\/ul>\n\n\n\n<p><strong>Have More Questions?&nbsp;Consult a Lawyer to Weigh the Options.<\/strong>&nbsp;<\/p>\n\n\n\n<p>When considering&nbsp;whether to litigate or arbitrate a dispute,&nbsp;remember that no two scenarios are identical.
