{"id":899986,"date":"2022-05-31T15:03:41","date_gmt":"2022-05-31T21:03:41","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=899986"},"modified":"2022-05-31T15:03:54","modified_gmt":"2022-05-31T21:03:54","slug":"delay-claims-as-built-schedule-analysis","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/delay-claims-as-built-schedule-analysis\/","title":{"rendered":"A Retrospective As-Built Schedule Analysis can be used to Support Delay"},"content":{"rendered":"\n<p>David Adelstein | <a href=\"https:\/\/www.floridaconstructionlegalupdates.com\/a-retrospective-as-built-schedule-analysis-can-be-used-to-support-delay\/\" target=\"_blank\" rel=\"noreferrer noopener\">Florida Construction Legal Updates<\/a><\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.myconstructionexpert.com\/blog\/delay-claims-proving-defending-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">Delay claims<\/a><\/strong>\u00a0are part of construction.\u00a0\u00a0 There should be no surprise why.\u00a0 Time is money.\u00a0 A delay claim should be accompanied by\u00a0<a href=\"http:\/\/www.adviseandconsult.net\/experts.php\"><strong>expert opinions<\/strong>\u00a0<\/a>that bolster evidence that gets introduced.\u00a0 The party against whom the delay claim is made will also have an expert \u2013 a rebuttal expert.\u00a0 Not surprisingly, each of the experts will rely on a different\u00a0<strong>critical path<\/strong>\u00a0as to relates to the same project.\u00a0\u00a0 The party claiming delay will rely on a critical path that shows the actions of the other party impacted their critical path and proximately caused the delay.\u00a0 This will be refuted by the opposing expert that will challenge the critical path and the actions claimed had no impact on the critical path (<em>i.e<\/em>., did not proximately cause the delay). Quintessential finger pointing!<\/p>\n\n\n\n<p>This was the situation in\u00a0<em>CTA I, LLC v. Department of Veteran Affairs<\/em>, CBCA 5826, 2022 WL 884710 (CBCA 2022), where the government terminated the contractor for convenience and the contractor claimed equitable adjustments for, among other things, delay.\u00a0\u00a0 The contractor\u2019s expert relied on an\u00a0<strong><a href=\"https:\/\/www.myconstructionexpert.com\/blog\/nine-best-practice-tips-analysis-construction-delays\/\" target=\"_blank\" rel=\"noreferrer noopener\">as-built critical path analysis<\/a><\/strong>\u00a0by \u201cretrospectively creating updates to insert between the contemporaneous updates.\u201d\u00a0\u00a0<em>Id., supra<\/em>, n.3.\u00a0 The government\u2019s expert did not do a retrospective as-built analysis and relied on only\u00a0<strong>contemporaneous schedule updates<\/strong>.\u00a0\u00a0<em>Id<\/em>.<\/p>\n\n\n\n<p>The government\u2019s expert testified he was not a fan of a retrospective (after-the-fact) as-built analysis because this analysis can lead to manipulation.&nbsp; He testified that he prefers to rely on contemporaneous schedule updates versus an as-built analysis where activities are added. &nbsp;&nbsp;The contractor\u2019s expert countered by saying the government\u2019s expert wants to ignore as-built facts which would warrant adjustments to contemporaneous project schedules to account for what actually occurred in the field.<\/p>\n\n\n\n<p>Who is right?&nbsp; Is a retrospective (after-the-fact) as built analysis credible?&nbsp;&nbsp; YES, it is. &nbsp;But, in an answering this question, let\u2019s bullet point some key aspects as articulated by the Civilian Board of Contract Appeals, which need to be underscored for importance:<\/p>\n\n\n\n<p>\uf0e0&nbsp;<strong>The contractor \u201chas burden of proving the extent of the delay, that the delay was&nbsp;<u>proximately caused<\/u>&nbsp;by government [owner] action, and the delay harmed\u201d the contractor.<\/strong>&nbsp;&nbsp;<em>CTA I, supra<\/em>&nbsp;(citation omitted).<\/p>\n\n\n\n<p>\uf0e0&nbsp;<strong>\u201cOnly delay on a project\u2019s&nbsp;<u>critical path<\/u>&nbsp;results in overall delay.\u201d<\/strong>&nbsp;&nbsp;<em>Id<\/em>.<\/p>\n\n\n\n<p>\uf0e0 \u201c<strong>As&nbsp;<u>as-built critical path<\/u>&nbsp;that reconstructs schedule updates is an acceptable methodology\u201d \u201c[A] rigorous \u2018as-built\u2019 approach- reviewing contemporaneous evidence in hindsight to trace the activities on the actual, longest path to completion-has been endorsed by government contracts tribunals.\u201d<\/strong>&nbsp;&nbsp;<em>Id<\/em>.<\/p>\n\n\n\n<p>\uf0e0&nbsp;<strong>\u201cBecause we must determine why a project lasted as long as it did, we [the Board] want to know the path to the latest work \u2013 including the critical work immediately preceding that work, and just before that, and so on.\u201d&nbsp;<\/strong><em>Id<\/em>.<\/p>\n\n\n\n<p>\uf0e0&nbsp;<strong>\u201cWe reject [the government\u2019s] accusation that retrospectively adjusting as-built schedules based on project documentation or other evidence necessarily turns the schedules into \u2018fiction.\u2019 There is, to be sure, a heavy presumption that regularly updated, contemporaneous schedules are the best evidence of project progress.\u201d<\/strong>&nbsp;&nbsp;<em>Id<\/em>.<\/p>\n\n\n\n<p>\uf0e0&nbsp;<strong>\u201c[F]orensic schedule analysis is \u2018both a science and an art\u2019 and \u2018not a magic wand\u2019 but a set of techniques requiring \u2018the application of an expert\u2019s well-considered judgment in evaluating the logic of underlying the various pieces of information that support the analysis.\u2019\u201d<\/strong>&nbsp;&nbsp;<em>Id<\/em>.<\/p>\n\n\n\n<p>\uf0e0\u00a0<strong>Even if relying on an as-built analysis, there needs to be persuasive contemporaneous project documents \u2013 \u201c[e]xpert opinions offered on certain matters that\u2026are not supported by the record tend[] to cast a shadow on the value of other opinions concerning issues where the underlying factual matters were less clear.\u201d<\/strong>\u00a0<em>Id<\/em>.
