{"id":900075,"date":"2022-06-23T14:58:38","date_gmt":"2022-06-23T20:58:38","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=900075"},"modified":"2022-06-23T14:58:40","modified_gmt":"2022-06-23T20:58:40","slug":"attorneys-fees-on-attorneys-fees","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/attorneys-fees-on-attorneys-fees\/","title":{"rendered":"Quick Note: Attorney&#8217;s Fees on Attorney&#8217;s Fees"},"content":{"rendered":"\n<p>David Adelstein | <a href=\"https:\/\/www.floridaconstructionlegalupdates.com\/quick-note-attorneys-fees-on-attorneys-fees\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida Construction Legal Updates<\/a><\/p>\n\n\n\n<p>In a recent\u00a0<a href=\"https:\/\/provemyfloridacase.com\/recovering-attorneys-fees-in-litigating-the-amount-of-attorneys-fees\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">case<\/a>, the appellate court held that the\u00a0<strong><a href=\"https:\/\/www.myconstructionexpert.com\/blog\/attorney-fees-provisions-must-contracts\/\" target=\"_blank\" rel=\"noreferrer noopener\">attorney\u2019s fees provision<\/a><\/strong>\u00a0in the contract was NOT broad enough to entitle the prevailing party to recover attorney\u2019s fees for litigating the amount of attorney\u2019s fees. \u00a0<strong>This is known as \u201cfees on fees\u201d which is when you can recover your prevailing party attorney\u2019s fees when you are fighting over the quantum that should be awarded to you as the prevailing party<\/strong>.<\/p>\n\n\n\n<p>The attorney\u2019s fees provision at-issue stated:<\/p>\n\n\n\n<p>\u201cIn any lawsuit to enforce the Lease or under applicable law, the party in whose favor a judgment or decree has been rendered may recover its reasonable court costs including attorney\u2019s fees from the non-prevailing party.\u201d<\/p>\n\n\n\n<p>Language similar to this language can be found in many contracts as a prevailing party attorney\u2019s fees provision.<\/p>\n\n\n\n<p>However, this provision was NOT broad enough to recover \u201cfees on fees.\u201d \u00a0 As explained in this\u00a0<a href=\"https:\/\/www.floridaconstructionlegalupdates.com\/attorneys-fees-for-litigating-the-amount-of-attorneys-fees\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">article<\/a>, if this is a consideration, you can\u00a0<strong>negotiate or include this provision into your construction contract<\/strong>\u00a0by expanding the scope of the prevailing party attorney\u2019s fees provision to clarify that it entitles the prevailing party to recover attorney\u2019s fees in litigating the amount of attorney\u2019s fees.<\/p>\n\n\n\n<p>There is both a good and bad to this. \u00a0The good is that if you are the prevailing party, you have a contractual basis to recover your fees for litigating the amount of fees. \u00a0The bad is that if you are the other party to this equation, it becomes harder to resolve a prevailing party attorney\u2019s fees issue when the other party is entitled to attorney\u2019s fees to litigate the reasonableness of attorney\u2019s fees. \u00a0Thus, you are in a position where you need to decide whether to pay the other party what they want to avoid continued fees or incurring more fees (both on your end and fees you will have to pay the other party) simply to argue over the amount of fees.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>When one of your cases is in need of a construction expert, estimates, insurance appraisal or umpire services in defect or insurance disputes &#8211;
