{"id":900156,"date":"2022-07-19T14:48:01","date_gmt":"2022-07-19T20:48:01","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=900156"},"modified":"2022-07-19T14:48:03","modified_gmt":"2022-07-19T20:48:03","slug":"miller-act-statute-of-limitations-equitable-tolling","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/miller-act-statute-of-limitations-equitable-tolling\/","title":{"rendered":"Miller Act Statute of Limitations and Equitable Tolling"},"content":{"rendered":"\n<p>David Adelstein | <a href=\"https:\/\/www.floridaconstructionlegalupdates.com\/miller-act-statute-of-limitations-and-equitable-tolling\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida Construction Legal Updates<\/a><\/p>\n\n\n\n<p><strong>When it comes to a <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/miller-act-preserve-your-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">Miller Act<\/a> payment bond claim, there is a one-year statute of limitations\u2014\u201cThe Miller Act contains a statute of limitations provision that requires actions to \u2018be brought no later than one year after the day on which the last of the labor was performed or material was supplied by the person bringing the claim.<\/strong>\u2019\u201d\u00a0<em>U.S. f\/u\/b\/o Techniquex Specialty Flooring, Inc., v. Philadelphia Indemnity Ins. Co<\/em>., 2022 WL 169070, *3 (M.D.Penn. 2022) (citing the Miller Act).<\/p>\n\n\n\n<p>There is an argument, albeit a difficult one, to support an&nbsp;<strong><u>equitable tolling<\/u><\/strong>&nbsp;of the one-year statute of limitations. This would be an argument filed when the one-year statute of limitations expires, but there is reason for missing the statute of limitations caused typically by the overt misleading of the defendant (surety\/bond-principal):<\/p>\n\n\n\n<p><strong>\u201cEquitable tolling functions to stop the statute of limitations from running where the claim\u2019s accrual date has passed.\u201d \u201cEquitable tolling is appropriate in three situations: (1) when the defendant has actively misled the plaintiff respecting the facts which comprise the plaintiff\u2019s cause of action; (2) when the plaintiff in some extraordinary way has been prevented from asserting his rights; and (3) when the plaintiff has timely asserted his rights in the wrong forum.\u201d The first ground for equitable tolling\u201cappears to be the same, in all important respects\u201d to equitable estoppel, which \u201cexcuses late filing where such tardiness results from active deception on the part of the defendant\u201d and \u201cwhat courts describe as \u2018equitable tolling\u2019 is encompassed by the latter two parts of our Circuit\u2019s doctrine.\u201d The extraordinary circumstances standard may be met \u201cwhere the defendant misleads the plaintiff, allowing the statutory period to lapse; or when the plaintiff has no reasonable way of discovering the wrong perpetrated against her \u2026\u201d<\/strong><\/p>\n\n\n\n<p><em>Tehniquex, supra<\/em>, at *5 (internal citations omitted).<\/p>\n\n\n\n<p>If you are involved on a federal project, it is imperative that you appreciate your Miller Act payment bond rights. \u00a0This includes knowing when your last date of furnishing is as well as your last date to file a Miller Act payment bond lawsuit. While equitable tolling is an argument if the statute of limitations expires, it is admittedly a very difficult argument to prevail on and will require evidence substantiating the basis for the equitable tolling. \u00a0Otherwise, you are just a party that missed the deadline to file a Miller Act payment bond claim, and in most occasions, there is really no justifiable reason for this to \u00a0be the situation.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><strong>When one of your cases is in need of a construction expert, estimates, insurance appraisal or umpire services in defect or insurance disputes &#8211;
