{"id":900868,"date":"2023-02-16T14:46:29","date_gmt":"2023-02-16T21:46:29","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=900868"},"modified":"2023-02-16T14:46:39","modified_gmt":"2023-02-16T21:46:39","slug":"public-adjuster-cant-be-appraiser","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/public-adjuster-cant-be-appraiser\/","title":{"rendered":"Public Adjusters Can\u2019t Also Be Appraisers on the Claim, Florida Supreme Court Finds"},"content":{"rendered":"\n<p>Jim Sams | <a href=\"https:\/\/www.insurancejournal.com\/news\/southeast\/2023\/02\/10\/707486.htm\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Insurance Journal<\/a><\/p>\n\n\n\n<p>A public adjuster cannot act as an <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/appraisal-and-impartiality-of-appraisers\/\" target=\"_blank\" rel=\"noreferrer noopener\">appraiser<\/a> for a homeowner they represent when the insurance policy specifies that the appraiser must be \u201cdisinterested,\u201d the Florida Supreme Court ruled Thursday.<\/p>\n\n\n\n<p>The high court\u00a0affirmed a 2nd District Court of Appeal decision\u00a0in a lawsuit filed by Jon Douglas Parrish against State Farm Insurance Co. over damages suffered during Hurricane Irma. Parrish wanted to use the chief executive officer of the public adjusting company he hired for his insurance claim to act as an appraiser to resolve a dispute with State Farm Florida Insurance Co.<\/p>\n\n\n\n<p>\u201cFinding no way around the plain meaning of the word \u2018disinterested,\u2019 we approve the 2nd District\u2019s decision below and hold that an appraiser cannot be \u2018disinterested\u2019 if he or she, or a firm in which he or she has an interest, is to be compensated for services as a public adjuster with a contingency fee,\u201d the 5-1 opinion says.<\/p>\n\n\n\n<div id=\"attachment_649246\" class=\"wp-block-image\"><figure class=\"alignleft\"><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2022\/01\/labarga-formal-original-2019-e1642034190874.jpg\" alt=\"\" class=\"wp-image-649246\"\/><figcaption>Labarga<\/figcaption><\/figure><\/div>\n\n\n\n<p>Justice Jorge Labarga dissented. He said the word \u201cdisinterested\u201d could also be taken to mean that appraisers must use independent judgment. Because the term is ambiguous, it must be interpreted to favor the insured, his dissenting opinion says.<\/p>\n\n\n\n<p>Parrish\u2019s home in Naples was damaged by Hurricane Irma in September 2017. He filed a claim and hired Keys Claims Consultants to assess the damage and cost of repairs. The contract called for KCC to be paid 10% of any amount recovered from State Farm.<\/p>\n\n\n\n<p>In January 2018, KCC sent State Farm a proof of loss valuing the damage at $495,079 and demanding an appraisal, naming its CEO George Keys as Parrish\u2019s appraiser. In February 2018, State Farm estimated the value of the loss to be $295,299 and sent Parrish a check for $107,157. Two months later, the insurer demanded an appraisal.<\/p>\n\n\n\n<p>State Farm petitioned the trial court to compel Parrish to appoint a different appraiser. The trial court found that Keys was \u201cdisinterested\u201d and should not be disqualified.<\/p>\n\n\n\n<p>The insurer appealed and Florida\u2019s 2nd District Court of Appeal reversed, ruling that a person who has a contingency fee agreement cannot be disinterested.<\/p>\n\n\n\n<p>Parrish appealed. He argued to the Supreme Court that \u201cover 25 years of uninterrupted case law\u201d allowed \u201cpublic adjusters to serve as the appraiser for the insured who hired them.\u201d The term \u201cdisinterested,\u201d Parrish argued, means only that the appraiser must be independent.<\/p>\n\n\n\n<p>But the Supreme Court said that Keys\u2019 \u201cpecuniary interest\u201d in the outcome of the appraisal disqualifies him.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft\"><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2017\/05\/tate-Farm-Insurance-Sign-And-151505015-e1676034157459-150x150.jpg\" alt=\"\" class=\"wp-image-450100\"\/><\/figure><\/div>\n\n\n\n<p>Attorney Steve Badger, a partner with the Zelle law firm in Dallas, said public adjusters acting as appraisers in the claims they are handling have been a big problem in Florida.<\/p>\n\n\n\n<p>\u201cHow can a public adjuster, who is hired to be an advocate for the insured in the claim process, also serve as a disinterested appraiser?\u201d he said in an email. \u201cHe can\u2019t.\u201d<\/p>\n\n\n\n<p>Badger said the ruling is another step toward reducing abusive conduct in the Florida appraisal process.<\/p>\n\n\n\n<p>\u201cAll appraisers should work on an hourly basis and should have had no prior involvement in the matter,\u201dhe said. \u201cPlain and simple.\u201d<\/p>\n\n\n\n<p>A spokesman for State Farm said the insurer is pleased with the decision.<\/p>\n\n\n\n<p>\u201cThe insurance contract requires each side to select someone who has no self-interest, including financial interest, in the appraisal,\u201d Roszell Gadson said in an email.<\/p>\n\n\n\n<p>The Florida Justice Reform Institute, often found on the side of insurers in litigation and legislative issues, had filed an amicus brief in the case.
