{"id":901254,"date":"2023-06-06T12:48:02","date_gmt":"2023-06-06T18:48:02","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=901254"},"modified":"2023-06-06T12:48:05","modified_gmt":"2023-06-06T18:48:05","slug":"civil-remedies-act-impacts-on-construction","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/civil-remedies-act-impacts-on-construction\/","title":{"rendered":"Florida&#8217;s New Civil Remedies Act &#8211; Bulletpoints as to How it Impacts Construction"},"content":{"rendered":"\n<p>David Adelstein | <a href=\"https:\/\/www.floridaconstructionlegalupdates.com\/floridas-new-civil-remedies-act-bulletpoints-as-to-how-it-impacts-construction\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida Construction Legal Updates<\/a><\/p>\n\n\n\n<p>There has been much talk about Florida\u2019s new\u00a0<strong>Civil Remedies Act<\/strong>\u00a0(<a href=\"https:\/\/www.myconstructionexpert.com\/blog\/tort-reform-bill-florida\/\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 837<\/a>) that Governor DeSantis approved on March 24, 2023.\u00a0 As it pertains to\u00a0<strong>construction<\/strong>, here is how I see it with key bulletpoints on the impact this new Act has on the construction industry:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>New Florida Statute s. 86.121<\/strong>\u2013 This is an attorney\u2019s fees statute for declaratory relief actions to the\u00a0<strong>prevailing insured<\/strong>\u00a0to determine insurance coverage after\u00a0<strong>TOTAL COVERAGE DENIAL<\/strong>. (<em>Note<\/em>: A defense offered pursuant to a reservation of rights is not a total coverage denial.) This right only belongs to the insured and cannot be transferred or assigned. And the parties are entitled to the summary procedure set forth in\u00a0<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0051\/Sections\/0051.011.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida Statute s. 51.011<\/a>\u00a0requiring the court to advance the cause on the calendar. The new statute does say it does NOT apply to any action arising under a residential or commercial property insurance policy. (Thus, since builder\u2019s risk coverage is a form of property insurance, the strong presumption is this new statute would not apply to it.) \u00a0Rather, the recent changes to\u00a0<a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0600-0699\/0626\/Sections\/0626.9373.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida Statute s. 626.9373<\/a>\u00a0would apply which provides, \u201c<strong>In any suit arising under a residential or commercial property insurance policy, there is no right to attorney fees under this section<\/strong>.\u201d<\/li>\n\n\n\n<li><strong>Florida Statute s. 95.11<\/strong>&nbsp;\u2013 The statute of limitations for negligence causes of action are&nbsp;<strong>two years<\/strong>&nbsp;instead of four years. This applies to \u201ccauses of action accruing after the effective date of this act.\u201d<\/li>\n\n\n\n<li><strong>Florida Statute s. 624.155<\/strong>&nbsp;\u2013 Adds language relative to bad faith insurance claims including bad faith claims asserted under the common law.<\/li>\n\n\n\n<li><strong>Florida Statute 768.81<\/strong>&nbsp;\u2013 Includes a greater percentage of fault section in the comparative negligence statute &nbsp;that states, \u201c<strong>In a negligence action to which this section applies, any party found to be greater than 50 percent at fault for his or her own harm may not recover any damages. This subsection does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766.<\/strong>\u201d<\/li>\n\n\n\n<li><strong>Florida Statute s. &nbsp;627.428<\/strong>\u2013 This statute was repealed. This was the attorney\u2019s fees statute for insurance disputes.<\/li>\n\n\n\n<li><strong>Florida Statute s. 627.756<\/strong>&nbsp;\u2013 This modified the language in this statute but still provides in a suit by an owner, contractor, a subcontractor, a laborer, or materialman against a surety under a&nbsp;<strong>payment or performance bond<\/strong>, if the claimant prevails, it can recover reasonable&nbsp;<strong>attorney\u2019s fees<\/strong>&nbsp;for prosecuting the suit.<\/li>\n\n\n\n<li>\u201cThis act shall not be construed to impair any right under an insurance contract in effect on or before the effective date of this act. To the extent that this act affects a right under an insurance contract, this act applies to an insurance contract issued or renewed after the effective date of this act.\u201d<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>When one of your cases is in need of a construction expert, estimates, insurance appraisal or umpire services in defect or insurance disputes &#8211;
