{"id":901612,"date":"2023-09-14T09:43:15","date_gmt":"2023-09-14T15:43:15","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=901612"},"modified":"2023-09-15T09:50:38","modified_gmt":"2023-09-15T15:50:38","slug":"timely-notice-first-circuit-holds-no-coverage","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/timely-notice-first-circuit-holds-no-coverage\/","title":{"rendered":"First Circuit Holds No Coverage Where Insured Failed to Provide Timely Notice of Claim"},"content":{"rendered":"\n<p>Emily Hart | <a href=\"https:\/\/www.executivesummaryblog.com\/First-Circuit-Holds-No-Coverage-Where-Insured-Failed-to-Provide-Timely-Notice-of-Claim\">Wiley Rein<\/a><\/p>\n\n\n\n<p>The United States Court of Appeals for the First Circuit, applying Massachusetts law, held that no coverage was available for a lawsuit because the insured failed to provide <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/prompt-notice-avoid-untimely-notice-defense\/\">timely notice<\/a> to the insurer.\u00a0<a href=\"https:\/\/www.executivesummaryblog.com\/assets\/htmldocuments\/Nahant-Preservation-Trust-Inc-v-Mount-Vernon-Fire-Ins-Co-public-version.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Nahant Preservation Trust, Inc. v. Mount Vernon Fire Ins. Co.<\/em>, 2023 WL 5266290 (1st Cir. Aug. 16, 2023)<\/a>.<\/p>\n\n\n\n<p>The insured maintained successive claims-made policies with the same insurer. Each policy required that the insured provide written notice of any claim to the insurer \u201cas soon as practicable,\u201d but in no event later than ninety days \u201cafter the expiration date\u201d of the policy. The insured was sued during the 2019-2020 policy period, but it did not provide notice of the lawsuit to the insurer until the 2020-2021 policy period, over ninety days after the expiration date of the 2019-2020 policy. The insurer denied coverage on the grounds that the insured failed to provide notice during the notification period of the 2019-2020 policy. The insured sued the insurer for coverage, and the district court granted the insurer\u2019s motion to dismiss.<\/p>\n\n\n\n<p>The First Circuit affirmed the district court\u2019s decision that no coverage was available because the insured failed to provide timely notice of the lawsuit.
