{"id":902113,"date":"2024-01-11T14:31:09","date_gmt":"2024-01-11T21:31:09","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=902113"},"modified":"2024-01-11T14:31:12","modified_gmt":"2024-01-11T21:31:12","slug":"project-labor-agreements-soon-required-federal-construction-projects","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/project-labor-agreements-soon-required-federal-construction-projects\/","title":{"rendered":"Federal Construction Projects Will Soon Require Project Labor Agreements Under New Rule"},"content":{"rendered":"\n<p>Christopher Caiaccio, Gunjan Talati, Kathryn Trent and Destiny Williams | <a href=\"https:\/\/ktslaw.com\/Blog\/governmentcontracting\/2024\/1\/federal%20construction%20projects%20will%20soon%20require%20project%20labor%20agreements%20under%20new%20rule\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Kilpatrick<\/a><\/p>\n\n\n\n<p>On December 18, 2023, the General Services Administration (\u201cGSA\u201d) announced a new final rule enforcing\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/02\/09\/2022-02869\/use-of-project-labor-agreements-for-federal-construction-projects\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Executive Order 14063<\/a>.\u00a0\u00a0The order requires federal agencies to use <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/labor-agreement-new-rule-proposed\/\">project labor agreements<\/a> (\u201cPLA\u201d), which are pre-hire collective bargaining agreements for construction, on large-scale federal construction projects.\u00a0\u00a0PLAs are negotiated with construction trades unions to establish terms and conditions of employment for all workers on specific federal construction projects.<\/p>\n\n\n\n<p>The new rule amends the Federal Acquisition Regulation, which provides guidelines for federal agency contracts.&nbsp;&nbsp;Under the new rule, any federal construction project that exceeds $35 million in total cost must enter into a PLA to establish the terms and conditions for the construction workers employed on such large-scale projects.&nbsp;The rule further mandates that all parties involved in the construction must negotiate and set the terms and conditions governing the construction project.<\/p>\n\n\n\n<p>According to the Biden Administration, the goal of this expansion is to ensure that federal construction projects are staffed with a steady supply of skilled workers and also to eliminate the risk of construction delays caused by labor unrest.<\/p>\n\n\n\n<p>The rule could impact nearly 200,000 workers on federal construction projects.&nbsp;&nbsp;The PLA requirement will go into effect on January 22, 2024.&nbsp;&nbsp;&nbsp;Opponents of this requirement say that it will discriminate against non-union contractors and significantly increase costs for federal construction projects.<\/p>\n\n\n\n<p>Kilpatrick\u2019s Labor &amp;
