{"id":902172,"date":"2024-01-24T15:59:49","date_gmt":"2024-01-24T22:59:49","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=902172"},"modified":"2024-01-24T15:59:53","modified_gmt":"2024-01-24T22:59:53","slug":"expert-witness-testimony-federal-rule-clarifies-requirements","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/expert-witness-testimony-federal-rule-clarifies-requirements\/","title":{"rendered":"Federal Rule Amendment Clarifies Requirements for Admitting Expert Testimony"},"content":{"rendered":"\n<p>Clifton Gruhn | <a href=\"https:\/\/www.carltonfields.com\/insights\/expect-focus\/2024\/federal-rule-amendment-clarifies-requirements\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Carlton Fields<\/a><\/p>\n\n\n\n<p>On December 1, 2023, Federal Rule of Evidence 702 was amended to \u201cclarify and emphasize\u201d that, before <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/expert-witness-testimony-federal-rule-of-evidence\/\">expert witness testimony<\/a> can be admitted, the proponent must satisfy all the rule\u2019s requirements by a preponderance of the evidence. After receiving more than 500 comments regarding proposed changes, the rule was amended as follows:<\/p>\n\n\n\n<p>A witness who is qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion or otherwise&nbsp;if&nbsp;the proponent demonstrates to the court that it is more likely than not that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a. the expert\u2019s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;<\/li>\n\n\n\n<li>b. the testimony is based on sufficient facts or data;<\/li>\n\n\n\n<li>c. the testimony is the product of reliable principles and methods; and<\/li>\n\n\n\n<li>d. the&nbsp;<s>expert has reliably applied<\/s>&nbsp;expert\u2019s opinion reflects a reliable application&nbsp;of&nbsp;the principles and methods to the facts of the case.<\/li>\n<\/ul>\n\n\n\n<p>Although the preponderance standard, represented by the addition of the \u201cmore likely than not\u201d language, applies to most admissibility issues, \u201cmany courts\u201d had misapplied the requirement by ruling that \u201ccritical questions of the sufficiency of an expert\u2019s basis, and the application of the expert\u2019s methodology,\u201d were issues of weight to be addressed during examination. The advisory committee notes clarify that such rulings \u201care an incorrect application\u201d of the rule. In the same vein, section (d) was amended to \u201cemphasize\u201d that all expert opinions must \u201cstay within the bounds of what can be concluded from a reliable application of the expert\u2019s basis and methodology.\u201d<\/p>\n\n\n\n<p>The amendment is intended to ensure that courts do not misinterpret the rules in ways that allow juries to hear inadmissible and potentially misleading expert testimony that they may not be qualified to evaluate.
