{"id":903400,"date":"2024-10-08T15:39:24","date_gmt":"2024-10-08T21:39:24","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=903400"},"modified":"2024-10-08T15:39:28","modified_gmt":"2024-10-08T21:39:28","slug":"scheduling-letter-for-construction-contractors","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/scheduling-letter-for-construction-contractors\/","title":{"rendered":"OFCCP Publishes New Scheduling Letter for Construction Contractors"},"content":{"rendered":"\n<p>Mitch Chamberlin and Evan Szarenski | <a href=\"https:\/\/blog.dciconsult.com\/construction-scheduling-letter-oct-2024\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">DCI Consulting<\/a><\/p>\n\n\n\n<p>On October 2, 2024, the\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/ofccp\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Office of Federal Contract Compliance Programs<\/a>\u00a0(OFCCP)\u00a0<a href=\"https:\/\/content.govdelivery.com\/accounts\/USDOLOFCCP\/bulletins\/3b98e21\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">announced<\/a>\u00a0that\u00a0the Office of Management and Budget (OMB)\u00a0has authorized a new\u00a0<a href=\"https:\/\/www.myconstructionexpert.com\/blog\/ofccp-proposes-revised-construction-scheduling-letter\/\">scheduling letter<\/a>\u00a0and itemized listing\u00a0for federal construction contractors\u00a0and subcontractors.\u00a0The new scheduling letter and itemized listing,\u00a0which are used to initiate\u00a0OFCCP\u00a0compliance evaluations, appear to have a number of substantive changes from the\u00a0version\u00a0letter\u00a0used previously.\u00a0These changes include:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Explicitly requesting payroll and personnel activity data for employees involved in the supervision, inspection, and other onsite functions incidental to actual construction<\/li>\n\n\n\n<li>Requesting EEO policies&nbsp;&nbsp;<\/li>\n\n\n\n<li>Requesting documentation that required construction contract clauses were included in subcontracts<\/li>\n\n\n\n<li>Requiring contractors to identify all tests and selection procedures used in hiring process and provide evidence that they were properly validated&nbsp;<\/li>\n\n\n\n<li>Requesting evidence that contractors were monitoring employment-related activities to ensure seniority practices, job classifications, work assignments, and other personnel practices did not have a discriminatory effect and that the EEO policy is being carried out&nbsp;<\/li>\n\n\n\n<li>Requiring documentation of outreach and recruitment efforts for VEVRAA and Section 503<\/li>\n\n\n\n<li>Requiring action-oriented programs to be developed if there is underutilization of individuals with disabilities&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Continued Focus on Construction Contractors<\/strong>&nbsp;<\/p>\n\n\n\n<p>OFCCP continues to have a greater focus on employers with federal construction contracts and subcontracts, which have significantly different requirements than employers with supply and service contracts.
