{"id":903632,"date":"2024-11-26T16:53:10","date_gmt":"2024-11-26T23:53:10","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=903632"},"modified":"2024-11-26T16:53:31","modified_gmt":"2024-11-26T23:53:31","slug":"deposition-how-not-to-defend","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/deposition-how-not-to-defend\/","title":{"rendered":"How Not to Defend a\u00a0Deposition"},"content":{"rendered":"\n<p><a href=\"https:\/\/www.esquiresolutions.com\/how-not-to-defend-a-deposition\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Esquire Deposition Solutions<\/a><\/p>\n\n\n\n<p><em>\u201cA review of the transcript demonstrates that Grosso\u2019s deposition was a waste of time.\u201d<\/em><\/p>\n\n\n\n<p>A fair reading of the facts set out in\u00a0<a href=\"https:\/\/nycourts.gov\/reporter\/pdfs\/2024\/2024_33906.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Phillips Auctioneers LLC v Grosso<\/a>, 2024 NY Slip Op 33906 (N.Y. Sup. Ct., N.Y. Cty., Oct.\u00a031, 2024), a contract dispute, suggests that both the witness and his attorney were determined to make the <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/deposition-eight-ethical-pitfalls-to-avoid\/\">deposition<\/a> as unpleasant and unproductive as possible. They succeeded spectacularly in these narrow objectives. According to the court, the witness was \u201cincoherent,\u201d \u201cunresponsive,\u201d and \u201cuncooperative.\u201d And the deposition came to an abrupt halt when the witness declared, \u201cThat was the last question.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cWhile sanctions for unethical conduct during depositions are rare, sharp-elbowed behavior is increasingly disfavored. Guardrails inhibiting over-zealous advocacy are found throughout professional ethics codes leading courts, on at least two occasions, to suspend a lawyer\u2019s license for unethical conduct during a deposition.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Success at frustrating the plaintiff\u2019s attempt to conduct a deposition ultimately proved pyrrhic in this instance. Not only did the trial court impose monetary sanctions for their obstructive behavior, it also:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ordered that the witness\u2019s next deposition take place in the court\u2019s jury room;<\/li>\n\n\n\n<li>imposed a tight and unforgiving (i.e.,\u00a0<a href=\"https:\/\/www.esquiresolutions.com\/terminating-sanctions-for-deposition-related-misbehavior\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">terminating sanctions<\/a>\u00a0are on the table) pretrial discovery schedule;<\/li>\n\n\n\n<li>ordered that the witness submit all of his electronic equipment for forensic imaging;<\/li>\n\n\n\n<li>ordered that the witness provide a \u201cJackson affidavit\u201d which, under New York practice, obliges the witness to explain in detail whatever information is known about documents that the witness claims are not in his possession or control; and<\/li>\n\n\n\n<li>gave a reading assignment, the\u00a0<a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/IP\/jipl\/pdf\/standardsofcivility.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">New York Standards of Civility<\/a>.<\/li>\n<\/ul>\n\n\n\n<p>Fortunately for the wider legal community, the court\u2019s opinion is a cook\u2019s tour of most, if not all, of the modern rules governing attorney behavior during a deposition.<\/p>\n\n\n\n<p>Here, in a nutshell, are all the ways defending counsel strayed from his ethical obligations during his client\u2019s deposition:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Engaging in dilatory tactics<\/strong>. The first deposition had been continued to a later date, but the witness\u2019s attorney cancelled it on less than 24 hours\u2019 notice, apparently because he believed the initial four hours of deposition time was \u201cenough.\u201d Under New York law, depositions can last seven hours. Following some email skirmishing, the deposition took place as scheduled.<\/li>\n\n\n\n<li><strong>Refusing to provide a legal basis for objections<\/strong>. Attorneys are obliged to provide a legal basis for objections made during a deposition. Here, the attorney\u2019s response to opposing counsel\u2019s request for a legal basis \u2013 \u201cNo, I am not your law clerk.\u201d \u2013 fell short of what is legally required.<\/li>\n\n\n\n<li><strong>Failing to demonstrate professionalism and civility<\/strong>. The remark \u201cNo, I am not your law clerk\u201d is also unprofessional and uncivil toward opposing counsel.<\/li>\n\n\n\n<li><strong>Directing the witness not to answer proper questions<\/strong>. Under New York law, the only grounds for directing a witness not to answer questions during a deposition are to preserve a privilege, to comply with a prior court protective order, to protect the witness from a question that is \u201cplainly improper.\u201d Here, the defending attorney was objecting to lawful questions.<\/li>\n\n\n\n<li><strong>Failing to prepare the witness to answer questions on foreseeable topics<\/strong>. The witness never conducted a search for documents requested by the plaintiff; in fact, he testified, \u201cnobody ever told him he needed to collect documents.\u201d<\/li>\n\n\n\n<li><strong>Coaching the witness<\/strong>. The attorney engaged in impermissible speaking objections, the court found. \u201c[C]oaching a witness was inappropriate making the deposition a waste of time.\u201d<\/li>\n\n\n\n<li><strong>Exhibiting disrespect toward opposing counsel<\/strong>. Attorneys are expected, the court said, to advise clients of lawful behavior during depositions and to make reasonable efforts to prevent clients from causing disorder or disruptions. Here, the court said, the attorney\u2019s remark that a deposition question was \u201cabsurd\u201d was disrespectful; moreover, it encouraged the witness to behave disrespectfully as well.<\/li>\n<\/ul>\n\n\n\n<p>For monetary sanctions, the court ruled that the plaintiff was entitled to reimbursement of the first, unproductive deposition as well as the costs for preparing again for a second deposition, plus the costs for attorney time during the deposition. The court also ordered reimbursement for costs associated with the plaintiff\u2019s motion for compelling discovery from the defendant, and costs associated with preparing for the defendant\u2019s upcoming courthouse deposition \u2013 which the court remarked was duplicative effort necessary solely because of the witness\u2019s and his attorney\u2019s improper conduct.<\/p>\n\n\n\n<p>While sanctions for unethical conduct during depositions are rare, sharp-elbowed behavior is increasingly disfavored.
