Revised\u00a0<a href=\"https:\/\/www.courts.wa.gov\/court_rules\/pdf\/CR\/SUP_CR_30_00_00.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Rule 30<\/a>\u00a0of the Washington Civil Rules will now allow <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/remote-depositions-five-strategies-to-optimize\/\">remote depositions<\/a> to be noticed without leave of court, subject to a very short time window for filing objections. The new rules also contain detailed restrictions on attorney and witness behavior during remote depositions.<\/p>\n\n\n\n<p>The new rules, which took effect Oct.\u00a01, 2024, were developed by the Board for Judicial Administration\u2019s\u00a0<a href=\"https:\/\/www.courts.wa.gov\/programs_orgs\/pos_bja\/?fa=pos_bja.courtRemoteTF%23:~:text=The%2520BJA%2520Remote%2520Proceedings%2520Workgroup,or%2520other%2520funding%2520as%2520needed.\" target=\"_blank\" rel=\"noreferrer noopener\">Remote Proceedings Work Group<\/a><a href=\"https:\/\/www.courts.wa.gov\/programs_orgs\/pos_bja\/?fa=pos_bja.courtRemoteTF%23:~:text=The%2520BJA%2520Remote%2520Proceedings%2520Workgroup,or%2520other%2520funding%2520as%2520needed.\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">https:\/\/www.courts.wa.gov\/programs_orgs\/pos_bja\/?fa=pos_bja.courtRemoteTF%23:~:text=The%2520BJA%2520Remote%2520Proceedings%2520Workgroup,or%2520other%2520funding%2520as%2520needed.<\/a>.<\/p>\n\n\n\n<p>Deposition practice in Washington has evolved several times since the early days of the COVID-19 pandemic. The state supreme court, in an\u00a0<a href=\"https:\/\/www.courts.wa.gov\/content\/publicUpload\/Supreme%2520Court%2520Orders\/Extended%2520and%2520Revised%2520SCT%2520Order%2520052820.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">emergency order entered May 28, 2020<\/a>, kept civil litigation moving along by encouraging lawyers \u201cto conduct discovery by remote means whenever possible.\u201d Two years later, the court,\u00a0<a href=\"https:\/\/www.esquiresolutions.com\/washington-high-court-announces-preference-for-remote-depositions\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">apparently satisfied with the bar\u2019s experience with remote depositions<\/a>, entered on Oct.\u00a027, 2022, a subsequent\u00a0<a href=\"https:\/\/www.courts.wa.gov\/content\/publicUpload\/Supreme%2520Court%2520Orders\/Order%252025700A697.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">administrative order<\/a>\u00a0providing that depositions \u201cshall be performed remotely absent agreement of the parties or a finding of good cause by the Court to require the depositions be performed in person.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>The court\u2019s most recent order reflects continuing high court support for remote depositions. However, instead of a prescriptive approach \u2013 e.g., depositions \u201cshall be performed remotely\u201d \u2013 Rule 30 now permits remote depositions to take place by notice alone, providing the opposing party a mere three days to file an objection.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Trial courts entertaining objections to remote depositions are asked to consider the following non-exhaustive factors when reaching their decision:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the role of the witness<\/li>\n\n\n\n<li>the complexity of the litigation<\/li>\n\n\n\n<li>whether the objecting party will be prejudiced by remote testimony<\/li>\n\n\n\n<li>whether the witness is subject to the court\u2019s subpoena power<\/li>\n<\/ul>\n\n\n\n<p>A final consideration mandated by revised Rule 30 is whether a remote deposition promotes the \u201cjust, speedy, and inexpensive determination\u201d of the litigation. Since July 9, 2024,\u00a0<a href=\"https:\/\/www.courts.wa.gov\/court_rules\/pdf\/CR\/SUP_CR_01_00_00.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Washington Civil Rule 1<\/a>\u00a0specifically identifies remote proceedings as a means of advancing this objective.<\/p>\n\n\n\n<p>The state supreme court also approved new language addressing concerns about the integrity of remote depositions, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>no alterations to the witness\u2019s demeanor and appearance can be made<\/li>\n\n\n\n<li>every person in the room with the witness must be audible and visible during the entirety of the deposition<\/li>\n\n\n\n<li>the witness may not refer to notes or electronic communications such as e-mail or chat during the deposition<\/li>\n\n\n\n<li>similarly, no one may attempt to influence the witness\u2019s answer to a question with notes, words, gestures, or electronic communications such as e-mail and chat during the deposition<\/li>\n<\/ul>\n\n\n\n<p>It is uncommon to see remote depositions regulated at such a detailed level. Compared to\u00a0<a href=\"https:\/\/www.law.cornell.edu\/rules\/frcp\/rule_30\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Rule 30<\/a>\u00a0of the Federal Rules of Civil Procedure, which has little specific to say about remote depositions, Washington\u2019s revised Rule 30 reflects a great deal of thought about how remote depositions are different than in-person depositions and how guardrails might be placed around remote proceedings to ensure that their benefits are preserved without compromising the integrity of the fact-finding process.<\/p>\n\n\n\n<p>The American Bar Association covered much of the same ground last year in\u00a0<a href=\"https:\/\/www.americanbar.org\/content\/dam\/aba\/directories\/policy\/midyear-2023\/505-midyear-2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Resolution 505 Best Practices for Remote Depositions<\/a>, which suggested that lawyers write their own remote deposition ground rules through\u00a0<a href=\"https:\/\/www.esquiresolutions.com\/aba-publishes-best-practices-for-success-in-remote-depositions\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">remote deposition protocols<\/a>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>When one of your cases is in need of a construction expert, estimates, insurance appraisal or umpire services in defect or insurance disputes &#8211; please call Advise &amp; Consult, Inc. at 888.684.8305, or email <a href=\"mailto:experts@adviseandconsult.net\">experts@adviseandconsult.net<\/a>.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Esquire Deposition Solutions The Washington Supreme Court recently approved significant revisions to that state\u2019s procedural rules on remote depositions.
