Hill | <a href=\"https:\/\/constructionlawva.com\/another-reminder-that-your-construction-contract-is-only-as-good-as-those-signing-it\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Construction Law Musings<\/a><\/p>\n\n\n\n<p>Here at Construction Law Musings, we beat the constant drum that \u201c<a href=\"https:\/\/constructionlawva.com\/affirmed-the-contract-is-king-in-virginia\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the contract is king<\/a>\u201d and \u201cdraft a\u00a0<a href=\"https:\/\/constructionlawva.com\/construction-contract-terms-matter-be-careful-when-you-draft-them\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">good and well-worded construction contract<\/a>\u201d consistently.\u00a0 As a\u00a0<a href=\"https:\/\/christopherhill-law.com\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Virginia construction attorney<\/a>, I stand by these statements and fully endorse a well-written construction contract.\u00a0 Such a contract will set expectations and\u00a0<a href=\"https:\/\/constructionlawva.com\/do-we-really-want-courts-deciding-if-our-construction-contracts-are-fair\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">provide the rules for your deal<\/a>\u00a0(particularly in the commercial context).\u00a0 Without this solid foundation (yes, I see the potential construction pun), when\u00a0<a href=\"https:\/\/constructionlawva.com\/murphy-was-optimist-how-deal-truth-on-construction-site\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">there are issues on the job site<\/a>, there will be no baseline for how to resolve those issues.<\/p>\n\n\n\n<p>That said, I am also reminded on an almost daily basis that humans interact with these contracts.&nbsp; People negotiate the contracts and are the main forces that drive the success (or failure) of the construction project.&nbsp; Money is involved (often a lot of it) and there can at times be temptations to try and squeeze one last dollar out of the job&nbsp;<em>despite what the contract says<\/em>.&nbsp; Even the strongest contract cannot act as real-time protection against one party that refuses to comply with the contract and its performance or payment terms.<\/p>\n\n\n\n<p>In this way, when you are entering a <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/substantial-completion-in-construction-contracts\/\">construction contract<\/a>, whether as an owner, general contractor, or subcontractor,\u00a0<a href=\"https:\/\/constructionlawva.com\/use-your-instincts-when-negotiating-a-construction-contract\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">be sure to use your instincts<\/a>.\u00a0 If you are negotiating with another party and your \u201cspidey sense\u201d tells you to walk away before it\u2019s too late, you should at the very least consider why the hair on your neck is standing up.\u00a0 If this happens, be sure to weigh that feeling when deciding price terms\u00a0<a href=\"https:\/\/constructionlawva.com\/construction-contract-basics-indemnity\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">or indemnification<\/a>\u00a0(for instance).\u00a0 If you\u2019re getting a bad feeling, you may want to hold a harder line on certain terms, seek a higher price, or walk away.\u00a0 Ultimately this decision will be a business one based upon your experience, instincts, and other non-legal factors.<\/p>\n\n\n\n<p>In short, don\u2019t ignore the guy on your shoulder saying \u201cBe careful.\u201d\u00a0 Doing so could save you from a bad project that costs more than simply walking away.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>When one of your cases is in need of a construction expert, estimates, insurance appraisal or umpire services in defect or insurance disputes &#8211; please call Advise &amp; Consult, Inc. at 888.684.8305, or email <a href=\"mailto:experts@adviseandconsult.net\">experts@adviseandconsult.net<\/a>.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Christopher G.
