{"id":904428,"date":"2025-06-05T09:17:56","date_gmt":"2025-06-05T15:17:56","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=904428"},"modified":"2025-06-05T09:18:00","modified_gmt":"2025-06-05T15:18:00","slug":"constructive-suspension-claim-does-exist","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/constructive-suspension-claim-does-exist\/","title":{"rendered":"A Claim For Constructive Suspension Does Exist"},"content":{"rendered":"\n<p>David Adelstein | <a href=\"https:\/\/www.floridaconstructionlegalupdates.com\/a-claim-for-constructive-suspension-does-exist\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida Construction Legal Updates<\/a><\/p>\n\n\n\n<p>A claim for\u00a0<strong><a href=\"https:\/\/www.myconstructionexpert.com\/blog\/construction-suspension-outside-express-order\/\">constructive suspension<\/a><\/strong>\u00a0does exist:<\/p>\n\n\n\n<p><strong>\u201c<u>Constructive suspension<\/u>&nbsp;occurs when work is stopped absent an express order by the contracting officer and the [G]overnment is found to be responsible for the work stoppage.\u201d&nbsp; \u201cA constructive suspension will be found on the same elements and has the same effect and consequences as an actual suspension.\u201d&nbsp;&nbsp;<u>To recover under the Suspension of Work clause, the contractor&nbsp; needs to prove four elements: \u201c(1) [the] contract performance was delayed; (2) the Government directly caused the delay; (3) the delay was for an unreasonable period of time; and (4) the delay injured the contractor in the form of additional expense or loss<\/u>.\u201d&nbsp; \u201cThe Government\u2019s actions [must be] the&nbsp;<em>sole<\/em>&nbsp;proximate cause for the contractor\u2019s&nbsp; additional loss, and the contractor&nbsp; would not have been delayed for any other reason during that period.\u201d&nbsp;<\/strong><\/p>\n\n\n\n<p><em>Quality Trust, Inc. v. Department of the Interior<\/em>, 2025 WL 1092348 (CBCA 2025) (internal citations omitted).<\/p>\n\n\n\n<p>The four elements are a must. If you fail to prove any of them, the suspension claim FAILS, whether it\u2019s an actual suspension claim or constructive suspension claim.<\/p>\n\n\n\n<p>In&nbsp;<em>Quality Trust, Inc<\/em>., the contractor could not prove the second element \u2013 the government solely caused the delay \u2013 because the government was NOT the sole cause of the delay. This means the suspension claim was not compensable.<\/p>\n\n\n\n<p>But, even if the suspension was the government\u2019s fault, the contractor could not prove the third element\u2014the delay was for an&nbsp;<strong>unreasonable<\/strong>&nbsp;amount of time. The word \u201cunreasonable\u201d does not refer to the government\u2019s motivation or purpose in requesting the suspension.&nbsp;<em>See Quality Trust, Inc., supra<\/em>&nbsp;(citation omitted).&nbsp;
