But if you\u2019re in the construction industry, whether you\u2019re a general contractor, architect, engineer, or product supplier, there\u2019s a good chance you\u2019re creating or using <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/architectural-drawings-important-license-terms-design-agreements\/\">intellectual property<\/a> (IP) every day.<\/p>\n\n\n\n<p>As a patent attorney at Clark Hill, I\u2019ve helped businesses across industries secure and enforce their IP rights. Here are three things you should know if you want to protect your work and avoid costly disputes in the construction world.<\/p>\n\n\n\n<p><strong>1. You might own more IP than you think<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/www.aia.org\/resource-center\/understanding-copyright-protection-architects\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Construction documents, blueprints, CAD files, and architectural renderings may be protected by copyright<\/a>, even if you didn\u2019t register them. If your firm creates custom designs or innovative building components, those could also be protected by patents or trade secrets. The same goes for proprietary estimating software, prefabrication processes, or even branding elements like logos and slogans.<\/p>\n\n\n\n<p>Just because your business is about bricks and steel doesn\u2019t mean your most valuable assets aren\u2019t intangible.<\/p>\n\n\n\n<p><strong>2. Contracts control who owns what<\/strong><\/p>\n\n\n\n<p>Questions such as \u201c<a href=\"https:\/\/www.ribaj.com\/intelligence\/intelligence-architects-need-to-know-about-copyright-when-taking-on-existing-projects\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Who owns the rights to a design \u2013 the architect or the client<\/a>?\u201d and \u201cCan a subcontractor re-use plans they created for your project?\u201d are governed by contracts, not common sense. Many companies, including construction firms, unintentionally give away their IP rights \u2013 or take on unexpected liability \u2013 because their standard agreements don\u2019t address ownership, licensing, or indemnification for IP infringement.<\/p>\n\n\n\n<p>A well-drafted contract or subcontractor agreement should spell out who owns what, who can use what, and who is financially responsible if someone gets sued.<\/p>\n\n\n\n<p><strong>3.
