On August 15, 2025, it released its revisions to\u00a0<a href=\"https:\/\/www.acquisition.gov\/far-overhaul\/far-part-deviation-guide\/far-overhaul-part-9\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">FAR Part 9 \u2013 Contractor Qualifications<\/a>,\u00a0<a href=\"https:\/\/www.acquisition.gov\/far-overhaul\/far-part-deviation-guide\/far-overhaul-part-33\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">FAR Part 33, Protests, Disputes, and Appeals<\/a>,\u00a0<a href=\"https:\/\/www.acquisition.gov\/far-overhaul\/far-part-deviation-guide\/far-overhaul-part-46\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">FAR Part 46, Quality Assurance<\/a>, and\u00a0<a href=\"https:\/\/www.acquisition.gov\/far-overhaul\/far-part-deviation-guide\/far-overhaul-part-49\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">FAR Part 49, Termination of Contracts<\/a>.<\/p>\n\n\n\n<p>Redlines showing the additions and deletions to each of these sections of the FAR are available here.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.schwabe.com\/wp-content\/uploads\/2025\/08\/PART-9.pdf\">PART 9<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.schwabe.com\/wp-content\/uploads\/2025\/08\/PART-33.pdf\">PART 33<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.schwabe.com\/wp-content\/uploads\/2025\/08\/PART-46.pdf\">PART 46<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.schwabe.com\/wp-content\/uploads\/2025\/08\/PART-49.pdf\">PART 49<\/a><\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/www.acquisition.gov\/far-overhaul\/far-part-deviation-guide\/far-overhaul-part-9\" target=\"_blank\" rel=\"noreferrer noopener\">FAR Part 9 \u2013 Contractor Qualifications<\/a>,<\/p>\n\n\n\n<p>FAR Part 9 establishes the standards and procedures for determining contractor responsibility and eligibility for federal contracts. Given that much of FAR Part 9 is statutorily mandated,\u00a0<a href=\"https:\/\/www.acquisition.gov\/sites\/default\/files\/practitioner_albums\/far-part-9-contractor-qualifications\/content\/index.html#\/lessons\/7sJi7Cv5zxrLJHuxUuBxx4wMmCIb5guF\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the FAR Council\u2019s changes are focused on word count, streamlining, and the use of plain language<\/a>.<\/p>\n\n\n\n<p>Notably, Subparts 9.6 Contractor Team Arrangements&nbsp;and&nbsp;9.7 Defense Production Pools and Research and Development Pools&nbsp;were removed and will be included in the forthcoming FAR Companion Guide.<\/p>\n\n\n\n<p>The Practitioner Album for FAR Part 9\u00a0<a href=\"https:\/\/www.acquisition.gov\/sites\/default\/files\/practitioner_albums\/far-part-9-contractor-qualifications\/content\/index.html#\/lessons\/Ou5HL6MLcFBO9MeX0nnf3KN8Heqh3wVi\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">emphasizes the use of \u201cQualified Bidders Lists (QBLs)<\/a>,\u201d which are described as \u201cpre-approved lists of contractors, vendors,\u00a0or suppliers who have met specific qualifications and criteria set by an organization that improve the quality and delivery speed of goods and services procured.\u201d The Practitioner Album recommends the use of QBLs for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Complex or High-Risk Projects, such as projects \u201cthat require specialized expertise, involve significant financial investment, or carry substantial risk, a QBL ensures that only capable and experienced contractors are considered.\u201d<\/li>\n\n\n\n<li>Recurring Needs for Specific Services, such as when an agency \u201cfrequently requires similar services (e.g., maintenance, construction),\u201d and<\/li>\n\n\n\n<li>Strict Regulatory Compliance where \u201cadherence to specific regulations and standards is critical (for instance, National Institute of Standards and Technology encryption standards FIPS 140-2 &amp; FIPS 197 for tactical communications equipment).\u201d<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/www.acquisition.gov\/far-overhaul\/far-part-deviation-guide\/far-overhaul-part-33\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">FAR Part 33, Protests, Disputes, and Appeals<\/a><\/p>\n\n\n\n<p>The FAR Council\u00a0<a href=\"https:\/\/www.acquisition.gov\/sites\/default\/files\/practitioner_albums\/far-part-33-protests-disputes-and-appeals\/content\/index.html#\/lessons\/g34AMyig5oDzlFJUSgB-Hmd-_tyOS5Tw\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">stated that FAR Part 33 was revised<\/a>\u00a0to \u201creflect administration priorities to reduce protests and resolve protests at the lowest level possible.\u201d \u00a0The FAR Council added a \u201cpurpose statement\u201d to FAR Part 33 that \u201csets forth the\u00a0objectives\u00a0of the bid protest\u00a0process (e.g., promote integrity in the process, deter abuse of the bid protest process), and emphasizes that it is\u00a0not intended to\u00a0serve as a way for offerors to get additional insight or be used by incumbents to delay contract transition.\u201d<\/p>\n\n\n\n<p>A focus of the revisions was on agency protests.\u00a0<a href=\"https:\/\/www.acquisition.gov\/sites\/default\/files\/practitioner_albums\/far-part-33-protests-disputes-and-appeals\/content\/index.html#\/lessons\/g34AMyig5oDzlFJUSgB-Hmd-_tyOS5Tw\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">The FAR Council described its changes as follows<\/a>:<\/p>\n\n\n\n<p>New requirements applicable to \u201cProtests to the Agency\u201d.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>104-4(a)(4)(ii) \u2013 Contracting officers\u00a0are required to report protests to the head of contracting activity (HCAs)\u00a0as soon as practicable after filing.<\/li>\n\n\n\n<li>104-4(a)(5)(ii) \u2013 Protesters electing independent review at a level above the CO\u00a0must be provided\u00a0a redacted copy of the source selection decision, and be provided an opportunity to submit a supplemental statement to the independent review official.<\/li>\n\n\n\n<li>These new requirements are expected to\u00a0increase confidence in the agency protest process, capture more data at the agency level on protests filed with contracting officers, allow for agency management to respond to procurement issues raised in protests, and resolve more protests at the agency level since protesters will have more information available to them.<\/li>\n<\/ul>\n\n\n\n<p>The FAR Council significantly reduced FAR 33.105, addressing protests filed with the GAO, as those provisions largely summarize GAO procedures that are already located at 4 CFR Part 21.<\/p>\n\n\n\n<p>Various procedural sections were consolidated into \u201cPostaward\u201d at FAR 33.205, including the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Initiation of a claim (former 33.206)<\/li>\n\n\n\n<li>Contractor certification (former 33.207)<\/li>\n\n\n\n<li>Interest on claims (former 33.208)<\/li>\n\n\n\n<li>The contracting officer\u2019s decision (former 33.211)<\/li>\n\n\n\n<li>Alternative Dispute Resolution (former 33.214)<\/li>\n<\/ul>\n\n\n\n<p>The FAR Companion Guide includes an emphasis on contracting officers providing transparency regarding award decisions, in hopes of reducing the number of protests that are filed in order to determine the basis for award, as opposed to a claim that the agency did something improper or made a mistake.\u00a0<a href=\"https:\/\/www.acquisition.gov\/sites\/default\/files\/practitioner_albums\/far-part-33-protests-disputes-and-appeals\/content\/index.html#\/lessons\/R93dPsbJwvRTSovvDAqGRIMVj2babc5_\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">The FAR Companion Guide addresses contracting officers and states<\/a>:<\/p>\n\n\n\n<p>While no procurement can be completely protest-proof, protest risks can be reduced through greater transparency in award processes and decisions.<\/p>\n\n\n\n<p>As a practitioner,&nbsp;you&nbsp;play a key role in building trust in the federal acquisition system, supporting both integrity and stakeholder confidence. Transparency fosters engagement, avoids costly delays or re-procurements caused by sustained protests, and ensures better use of taxpayer dollars.<\/p>\n\n\n\n<p>For both government and industry, it creates opportunities to identify improvements in procurement procedures and strengthen future submissions. By remaining open to industry feedback, you can enhance future opportunities and contribute to a more effective acquisition system.<\/p>\n\n\n\n<p>As part of this, the FAR Companion Guide recommends the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cComplex evaluation schemes\u00a0with multiple factors, subfactors, and unclear evaluation criteria\u00a0carry\u00a0higher protest risk.\u00a0When determining your evaluation method, consider how you can be fair and reasonable while maintaining appropriate flexibility to select the best vendor to support your mission requirement.\u201d<\/li>\n\n\n\n<li>\u201cIf using adjectival ratings, align them with the solicitation and support findings with clear, adequate\u00a0rationale to strengthen the evaluation record.\u201d<\/li>\n\n\n\n<li>\u201cKeep\u00a0decision documents brief, focused on material elements, and useful for post-award communications.\u201d<\/li>\n\n\n\n<li>\u201cDocument the government\u2019s decisions\u2014not its deliberations.\u201d<\/li>\n\n\n\n<li>\u201cProvide timely debriefings or brief explanations\u2014benefiting both government and industry.\u201d<\/li>\n\n\n\n<li>\u201cWhen debriefings are requested, consider sharing redacted decision and evaluation documents\u2014already discoverable in protests\u2014to improve transparency.\u201d<\/li>\n<\/ul>\n\n\n\n<p>For contract claims, i.e., disputes arising after award, the\u00a0<a href=\"https:\/\/www.acquisition.gov\/sites\/default\/files\/practitioner_albums\/far-part-33-protests-disputes-and-appeals\/content\/index.html#\/lessons\/R93dPsbJwvRTSovvDAqGRIMVj2babc5_\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">FAR Companion Guide points contracting officers to various resources that may be of interest and assistance to contractors who are considering or litigating claims<\/a>:<\/p>\n\n\n\n<p><strong>DAU Acquipedia \u2013 Contract Claims:\u00a0<\/strong>Acquipedia is an online encyclopedia of defense acquisition topics, providing definitions, context, and links to relevant policies, guidance, tools, practices, and training.
