{"id":904854,"date":"2025-10-01T14:35:24","date_gmt":"2025-10-01T20:35:24","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=904854"},"modified":"2025-10-01T14:35:30","modified_gmt":"2025-10-01T20:35:30","slug":"osha-deregulatory-efforts-begin","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/osha-deregulatory-efforts-begin\/","title":{"rendered":"OSHA\u2019s Aggressive Deregulatory Efforts Begin"},"content":{"rendered":"\n<p>Brandon Brigham, Kaiser Chowdhry, Thomas Cullen Wallace and Megan Lipsky | <a href=\"https:\/\/www.morganlewis.com\/pubs\/2025\/07\/oshas-aggressive-deregulatory-efforts-begin\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Morgan Lewis<\/a><\/p>\n\n\n\n<p>The Occupational Safety and Health Administration (OSHA) has begun what the US Department of Labor\u00a0<a href=\"https:\/\/www.dol.gov\/newsroom\/releases\/osec\/osec20250701-0\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">describes<\/a>\u00a0as \u201caggressive deregulatory efforts\u201d to \u201cput American workers and job creators first.\u201d In response to President Donald Trump\u2019s\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/02\/06\/2025-02345\/unleashing-prosperity-through-deregulation\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Executive Order 14192<\/a>, titled \u201cUnleashing Prosperity Through Deregulation,\u201d OSHA published 25 proposed rules and one final rule in the\u00a0<em>Federal Register<\/em>\u00a0on July 1, each of which is aimed to \u201ccut regulatory burdens, spur job creation, and fuel economic opportunity.\u201d<\/p>\n\n\n\n<p>These rules propose, among other things, limiting the scope of the General Duty Clause, revising respiratory protection medical requirements for certain devices and chemicals, providing greater flexibility in an employee\u2019s choice of respiratory protection when working with certain chemicals, and eliminating dozens of other regulatory requirements that the agency contends are outdated or duplicative.<\/p>\n\n\n\n<p>This is the first of what we can assume will be several rounds of rollbacks of regulations that this administration has deemed \u201cobsolete and burdensome.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">CLARIFICATION OF THE GENERAL DUTY CLAUSE<\/h4>\n\n\n\n<p>OSHA\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-12236\/occupational-safety-and-health-standards-interpretation-of-the-general-duty-clause-limitation-for\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">proposes<\/a>\u00a0to clarify its interpretation of the General Duty Clause \u201cto exclude from enforcement known hazards that are inherent and inseparable from the core nature of a professional activity or performance.\u201d<\/p>\n\n\n\n<p>OSHA relies upon the General Duty Clause, 29 USC 654(a)(1), to cite employers when a hazard in the workplace is not covered by a specific OSHA standard. Through this rulemaking, the agency seeks to align its interpretation of the General Duty clause with a dissent filed by then-DC Circuit Judge Brett Kavanaugh in&nbsp;<em>SeaWorld of Florida LLC v. Perez<\/em>, 748 F.3d 1202 (DC Cir. 2014).<\/p>\n\n\n\n<p>There, the court found SeaWorld was liable under the General Duty Clause for exposing employees to the recognized hazard of working with orca whales during live performances without providing adequate protection, such as a physical barrier between the whale and the trainer. Judge Kavanaugh, in a lone dissent, opined that the General Duty Clause does not authorize OSHA to regulate hazards arising from normal activities that are intrinsic to sports or entertainment occupations.<\/p>\n\n\n\n<p>In light of the issues raised in that dissent and subsequent developments in administrative and constitutional law, OSHA now attempts to codify \u201cthe principle that the General Duty Clause does not authorize OSHA to prohibit, restrict, or penalize inherently risky activities that are intrinsic to professional, athletic, or entertainment occupations.\u201d<\/p>\n\n\n\n<p>Specifically, the rule \u201cwould provide that the General Duty Clause does not require employers to remove hazards arising from inherently risky employment activities, where: the activity is integral to the essential function of a professional or performance-based occupation; and the hazard cannot be eliminated without fundamentally altering or prohibiting the activity.\u201d<\/p>\n\n\n\n<p>While&nbsp;<em>Sea World<\/em>&nbsp;focused on the sports and entertainment industries, where some risk of physical injury is intrinsic, OSHA\u2019s reasoning could apply more generally to the full range of occupational activities where inherent risks are involved. Interested parties must submit comments on this proposed rule by September 2.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">REMOVING MEDICAL EVALUATION REQUIREMENTS FOR CERTAIN RESPIRATORS<\/h4>\n\n\n\n<p>OSHA\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-12235\/amending-the-medical-evaluation-requirements-in-the-respiratory-protection-standard-for-certain\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">proposes<\/a>\u00a0removing certain medical evaluation requirements in the Respiratory Protection Rule for filtering facepiece respirators (FFRs) and loose-fitting powered air-purifying respirators (PAPRs). While its current rule requires an employer to complete medical evaluations (as part of an employer\u2019s Respiratory Protection Program) to determine whether an employee is physically able to wear a given respirator, OSHA now takes the position that current data is \u201clacking and insufficient to establish that medical evaluations meaningfully reduce material impairment caused by wearing\u201d these types of respirators. If finalized, the rule would remove medical evaluation requirements for these two respirator types.<\/p>\n\n\n\n<p>OSHA\u2019s proposals would also provide employers greater flexibility in the respiratory protection they select for workers who are exposed to the following substances in the workplace:\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11629\/12-dibromo-3-chloropropane\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">1,2-dibromo-3-chloropropane<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11630\/title-13-butadiene\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">1,3-butadiene<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11631\/13-carcinogens-4-nitrobiphenyl-etc\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">13 carcinogens (4-nitrobiphenyl, etc.)<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11632\/acrylonitrile\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">acrylonitrile<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11633\/asbestos\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">asbestos<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11634\/benzene\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">benzene<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11635\/cadmium\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">cadmium<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11636\/coke-oven-emissions\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">coke oven emissions<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11637\/cotton-dust\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">cotton dust<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11638\/ethylene-oxide\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">ethylene oxide<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11639\/formaldehyde\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">formaldehyde<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11640\/inorganic-arsenic\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">inorganic arsenic<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11641\/lead\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">lead<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11642\/methylene-chloride\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">methylene chloride<\/a>;\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11643\/methylenedianiline\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">methylenedianiline<\/a>; and\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11644\/vinyl-chloride\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">vinyl chloride<\/a>. Each of these proposals will delete substance-specific standard requirements duplicative of the general respiratory requirements in 29 CFR 1910.134 and will \u201cremove unnecessary restrictions on respirator selection where another equally protective option exists.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">STREAMLINING RECORDKEEPING AND REPORTING<\/h4>\n\n\n\n<p>OSHA\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11624\/occupational-injury-and-illness-recording-and-reporting-requirements-withdrawal\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">also withdrew<\/a>\u00a0its proposed rule that would have added a new column to the OSHA 300 log for work-related musculoskeletal disorders (MSDs). In so doing, OSHA determined that \u201cthe MSD column would not materially improve the information currently available from national statistics on MSDs.\u201d The proposal\u2019s withdrawal is effective immediately; however, this does not change an employer\u2019s obligation to complete and retain occupational injury and illness records.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">CHANGES TO CONSTRUCTION SAFETY STANDARDS<\/h4>\n\n\n\n<p>OSHA also issued one\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-12011\/construction-standards-advisory-committee-on-construction-safety-and-health\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">final rule<\/a>\u00a0that will revoke 29 CFR 1911.10 and 29 CFR 1912.3. Because these provisions imposed burdens on the assistant secretary beyond those mandated by statute, and \u201cneedlessly delay[ed]\u201d the secretary of labor\u2019s regulatory agenda, the assistant secretary for OSHA is no longer required to consult with the Advisory Committee on Construction Safety and Health in formulating new rules applicable to construction work.<\/p>\n\n\n\n<p>OSHA also\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/01\/2025-11645\/construction-illumination\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">proposes<\/a>\u00a0rescinding its construction illumination requirements in 29 CFR 1926.26 and 1926.56. This would remove the requirement that construction areas, aisles, stairs, ramps, runways, corridors, offices, shops, and storage areas where work is in progress be lighted with either natural or artificial illumination.
