Unlike arbitration or litigation, the mediator does not make a binding decision.&nbsp; Instead, the mediator facilitates discussion and negotiation. &nbsp;The only aspect of mediation that may result in a binding obligation is if the process results in the parties settling their dispute, which is almost always formalized in a written agreement.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Advantages:<\/strong>\u00a0Mediation is private and confidential, encouraging open and honest communication. It is flexible, allowing parties to switch mediators if needed. \u00a0Because of its confidential nature, mediation is highly effective in resolving disputes. \u00a0The process is typically less adversarial than arbitration or litigation, helping preserve relationships.<\/li>\n\n\n\n<li><strong>Approach:<\/strong>\u00a0One common approach is the\u00a0<em>caucus approach<\/em><strong>,<\/strong>\u00a0where the mediator meets privately with each party, often in separate rooms, to discuss concerns and negotiate.\u00a0 The mediator\u2019s role is to help the parties communicate and work toward a reasonable resolution of their dispute. Whether the mediator takes an advisory role (offering suggestions) or simply acts as a messenger depends on what the parties prefer. \u00a0It is important for the mediator to clarify this role early in the process by consulting each party separately.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Arbitration<\/h4>\n\n\n\n<p><strong>Arbitration<\/strong>&nbsp;offers a middle ground between informal negotiation and formal litigation.&nbsp; It is a streamlined, private process where disputes are resolved by an arbitrator or a panel or arbitrators rather than a judge.&nbsp; Where the parties agree to submit their conflict to a&nbsp;<strong>neutral individual&nbsp;<\/strong>or a&nbsp;<strong>panel of arbitrators<\/strong>&nbsp;for re<strong>v<\/strong>iew.&nbsp; Before the process begins, both sides decide whether the arbitrator\u2019s decision will be&nbsp;<strong>binding<\/strong>&nbsp;(final and enforceable) or&nbsp;<strong>nonbinding<\/strong>&nbsp;(a recommendation that either party may reject).&nbsp; Arbitration is generally less formal and more efficient than court litigation, while still providing a structured process for presenting evidence and arguments.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Advantages:<\/strong>\u00a0Arbitration is typically faster and less costly than litigation. \u00a0Although it often has a greater up front cost given the arbitrator\u2019s compensation.\u00a0 Because it doesn\u2019t depend on a court\u2019s schedule, hearings can be held remotely or in person, making the process more flexible and convenient.\u00a0 It also tends to be less adversarial, helping preserve business or personal relationships.\u00a0 In cases where similar disputes occur repeatedly, arbitration can provide greater predictability and consistency in outcomes, especially if the arbitrator chosen has industry-specific knowledge.<\/li>\n\n\n\n<li><strong>Disadvantages:<\/strong>\u00a0Arbitration has its limitations.\u00a0 Arbitrators are often more conservative than juries, meaning the potential for a large monetary award is lower. \u00a0The process is also private, so there\u2019s no public recognition or precedent\u2014and for some parties, that lack of notoriety or validation can feel unsatisfying. \u00a0Finally, because arbitration decisions in binding cases are difficult to appeal, there is limited recourse if one side disagrees with the result.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Litigation<\/h4>\n\n\n\n<p>Litigation is the traditional court process where a judge or jury decides the outcome of a dispute.
