The more experience you have,\u00a0the easier it is to know the good cards, the bad cards and how to\u00a0play them. But what happens when you are\u00a0dealt with\u00a0a\u00a0\u201cwildcard\u201d? This is what it can feel like when\u00a0matched against\u00a0a\u00a0self-represented, or <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/sactions-against-pro-se-plaintiff-upheld\/\">pro se<\/a>,\u00a0litigant.\u00a0Whether as a claims adjuster or an insurance defense attorney,\u00a0we often take for granted that the process\u00a0from the\u00a0initial\u00a0claim through litigation\u00a0will follow a standard procedure. But the introduction of someone who is unfamiliar with this\u00a0process\u00a0can serve as a sudden reminder\u00a0of how quickly \u201cstandard\u00a0procedure\u201d can go awry.\u00a0This does not have to be the case and with some practical considerations, many of the pitfalls of working with\u00a0pro se\u00a0litigants can be avoided.\u00a0\u00a0<\/p>\n\n\n\n<p><strong>Communication Matters<\/strong>&nbsp;<\/p>\n\n\n\n<p>The reality of dealing with an unrepresented claimant\/plaintiff is that their motivations are fundamentally different than those of typical opposing counsel.&nbsp;They&nbsp;are&nbsp;often&nbsp;driven more by principle than facts, emotionally tied to the underlying claims and singularly focused on their one and only case. Additionally, these pro se&nbsp;litigants&nbsp;are&nbsp;operating&nbsp;in a way that they believe they are&nbsp;<em>supposed to<\/em>, rather than from a place of&nbsp;expertise&nbsp;or experience.&nbsp;An average person is made to believe that the claims and litigation processes are inherently&nbsp;confrontational,&nbsp;and when&nbsp;representing&nbsp;oneself, these litigants enter with that mentality. We must prepare for skepticism and defensiveness in our communications and be prepared with the tools to minimize these reactions.&nbsp;To do this, consider the following:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Remind\u00a0them what your role is<\/strong>.\u00a0Do not assume that a\u00a0pro se litigant\u00a0knows\u00a0who\u00a0exactly you are or who your client is. Clarify your role and responsibility in the\u00a0matter. On one hand, this explains the motivations behind your actions, but this also makes things less personal and provides\u00a0perspective;\u00a0<\/li>\n\n\n\n<li><strong>Cut through the adversarial nature of the situation by offering common ground<\/strong>. This may be\u00a0highlighting\u00a0agreed upon facts,\u00a0or\u00a0allowing\u00a0for compromise where\u00a0possible;\u00a0\u00a0<\/li>\n\n\n\n<li><strong>Explain\u00a0the\u00a0larger picture of the claims\/litigation<\/strong>. This can\u00a0describe\u00a0your expectations for next steps along the way,\u00a0stating\u00a0how you typically handle similar cases, and\/or\u00a0clarifying the purpose of each step in the process.\u00a0\u00a0<\/li>\n\n\n\n<li>(<em>Note: Always\u00a0strive\u00a0to avoid talking down to them or overwhelming them with information)\u00a0\u00a0<\/em>\u00a0<\/li>\n<\/ul>\n\n\n\n<p>While we must make these efforts towards productive communications, we&nbsp;equally&nbsp;must&nbsp;stay focused on protecting&nbsp;our clients.&nbsp;Dealing with someone who is unrepresented requires more deliberate and precise&nbsp;communication&nbsp;than usual. In that regard, consider the following:&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Primarily communicate in writing\u00a0if possible<\/strong>. This will help avoid disputes over ambiguous or misinterpreted conversations.\u00a0Keep this polite,\u00a0professional\u00a0and clear\u00a0as\u00a0all communications\u00a0could end up as\u00a0exhibits\u00a0before the\u00a0court;\u00a0<\/li>\n\n\n\n<li><strong>Prepare for\u00a0potential misunderstandings<\/strong>. You can never guarantee how someone will receive information, but avoiding vague or confusing language will certainly help.\u00a0\u00a0<\/li>\n\n\n\n<li>Example:\u00a0In a typical situation it may be fine to tell someone that\u00a0\u201cwe\u2019d like to get this worked out.\u201d But it is not\u00a0out of the realm of possibility that this could\u00a0be understood by a pro se claimant as \u201cthey\u2019re going to pay me for this accident.\u201d\u00a0\u00a0<\/li>\n\n\n\n<li><strong>Do\u00a0not take anything for granted<\/strong>. We cannot assume that\u00a0the usual\u00a0proceedings of a case will\u00a0be held\u00a0in these situations. If something seems unclear, make sure to clarify, even if it seems trivial.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>Litigating Against a Pro Se Plaintiff&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>In the eyes of the Georgia case law,&nbsp;there should be few differences in the requirements and responsibilities of pro se litigants and practicing attorneys. It has been clear that when \u201cone&nbsp;who knowingly elects to represent himself assumes full responsibility for complying with the substantive and procedural requirements of the&nbsp;law.\u201d&nbsp;<em>Bazan v. Bazan&nbsp;<\/em>(Ga. Ct. App. 2018).&nbsp;<em>Bazan&nbsp;<\/em>also&nbsp;states&nbsp;that&nbsp;besides \u201cholding\u202fpro\u202fse\u202flitigants\u202fto less stringent standards than attorneys with respect to their pleadings, a court cannot apply different standards to a\u202fpro\u202fse\u202fcivil\u202flitigant\u202fand one represented by counsel.\u201d While this may be, those of us who have found ourselves opposing a pro se Plaintiff in front of a Judge know that the court\u2019s \u201cless stringent standards\u201d are often applied well beyond pleadings.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The reality is that once suit is filed and the Plaintiff has elected to proceed pro se,&nbsp;courts are likely to give the unrepresented party the benefit of the doubt&nbsp;more often than not.&nbsp;As attorneys, this&nbsp;can be frustrating. We&nbsp;have to&nbsp;be aware that along with certain leniencies Judges&nbsp;show&nbsp;pro se litigants, they also often&nbsp;place&nbsp;heightened expectations on&nbsp;opposing attorneys&nbsp;to keep the case on track.&nbsp;In these cases,&nbsp;Judges may expect the attorney to manage&nbsp;things like&nbsp;the&nbsp;discovery timelines&nbsp;for&nbsp;all&nbsp;parties,&nbsp;take&nbsp;the lead on joint pleadings or&nbsp;proactively remind&nbsp;the pro se Plaintiff of their own obligations.&nbsp;The court\u2019s expectation is that we as attorneys know better&nbsp;than those who are unrepresented. To meet that expectation,&nbsp;it is important that we&nbsp;remain&nbsp;consistent and diligent in our management of&nbsp;these cases.&nbsp;We can&nbsp;accomplish&nbsp;this by:&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Communicating openly with the pro se Plaintiff about your expectations for timelines and events in\u00a0litigation;\u00a0<\/li>\n\n\n\n<li>Clearly\u00a0stating\u00a0procedural or discovery issues to the pro se Plaintiff before bringing these to the\u00a0court;\u00a0<\/li>\n\n\n\n<li>Avoiding\u00a0any appearance\u00a0of bullying or talking down to a pro se Plaintiff,\u00a0as judges are particularly quick to reprimand this behavior;\u00a0<\/li>\n\n\n\n<li>\u00a0Documenting all work\u00a0in the case\u00a0to\u00a0distinguish your\u00a0efforts\u00a0from a pro se Plaintiff\u2019s\u00a0potential\u00a0inactivity and\/or inattention.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<p>The\u00a0difficulties in opposing a pro se litigant lie in the deviations from our expectations.
