For architects, engineers, and other licensed construction professionals, the ruling substantially limits the enforceability of state-law <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/tag\/certificate-of-merit\/\">certificate or affidavit of merit<\/a> statutes in federal diversity actions.<\/p>\n\n\n\n<p>Although&nbsp;<em>Berk<\/em>&nbsp;arose from a medical malpractice claim, the Court\u2019s reasoning applies equally to state statutes requiring pre-suit expert certifications in claims against design professionals.
