{"id":905771,"date":"2026-06-10T15:05:33","date_gmt":"2026-06-10T21:05:33","guid":{"rendered":"https:\/\/www.myconstructionexpert.com\/blog\/?p=905771"},"modified":"2026-06-10T15:05:36","modified_gmt":"2026-06-10T21:05:36","slug":"mechanics-lien-how-much-can-subcontractor-collect","status":"publish","type":"post","link":"https:\/\/www.myconstructionexpert.com\/blog\/mechanics-lien-how-much-can-subcontractor-collect\/","title":{"rendered":"How Much Can A Subcontractor Collect on Its Mechanics\u2019 Lien?"},"content":{"rendered":"\n<p>Jonathan Freiberger | <a href=\"https:\/\/www.fhnylaw.com\/how-much-can-a-subcontractor-collect-on-its-mechanics-lien\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Freiberger Haber<\/a><\/p>\n\n\n\n<p id=\"viewer-tbgf1693\">As discussed in our recent article \u201c<a href=\"https:\/\/www.fhnylaw.com\/mechanics-liens-and-discharge-bonds\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><u>Mechanics\u2019 Liens and Discharge Bonds<\/u><\/a>,\u201d mechanics\u2019 liens are powerful tools available to, <em>inter alia<\/em>, contractors, laborers, and materialmen when they are not paid for their work in improving real property. As the Court of Appeals noted long ago:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The object and purpose of the mechanics&#8217; lien law was to protect a person who, with the consent of the owner of real property, enhanced its value by furnishing materials or performing labor in its improvement, by giving him an interest therein to the extent of the value of such material or labor. The filing of the notice of lien is the statutory method prescribed by which the party entitled thereto perfects his inchoate right to that interest.<\/p>\n<\/blockquote>\n\n\n\n<p id=\"viewer-qu5i9488\"><a href=\"https:\/\/www.casemine.com\/judgement\/us\/5914aa77add7b04934723852\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em><u>John P. Kane Co. v. Kinney<\/u><\/em><\/a>, 174 N.Y. 69, 73 (1903). \u201cThe Lien Law provides that article 2, which governs <a href=\"https:\/\/www.myconstructionexpert.com\/blog\/clarifying-mechanics-lien-law\/\">mechanics\u2019 liens<\/a>, \u2018is to be construed liberally to secure the beneficial interests and purposes thereof\u2019 (<a href=\"https:\/\/codes.findlaw.com\/ny\/lien-law\/lie-sect-23.html\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><u>Lien Law \u00a7 23<\/u><\/a>).\u201d <a href=\"https:\/\/law.justia.com\/cases\/new-york\/court-of-appeals\/1995\/87-n-y-2d-148-0.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em><u>West-Fair Elec. Contractors v. Aetna Cas. &amp; Sur. Co<\/u><\/em><u>.<\/u><\/a>, 87 N.Y.2d 148, 156 (1995). A subcontractor is entitled to file a mechanics\u2019 lien \u201cfor the value or the agreed price of the labor or materials furnished at the request or consent of the owner&#8217;s contractor. <em>Id<\/em>\u00a0at 157; <em>see also<\/em> <a href=\"https:\/\/codes.findlaw.com\/ny\/lien-law\/lie-sect-3\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><u>Lien Law \u00a7 3<\/u><\/a>. However, the lien cannot be for more than the \u201csum earned and unpaid on the contract at the time of filing the notice of lien, and any sum subsequently earned thereon\u201d and, the owner is not liable to pay lienors more than the \u201cvalue or agreed price of the labor and materials remaining unpaid, at the time of filing notices of such liens.\u201d <a href=\"https:\/\/codes.findlaw.com\/ny\/lien-law\/lie-sect-4\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><u>Lien Law \u00a7 4(1)<\/u><\/a>.<\/p>\n\n\n\n<p id=\"viewer-9ez3m504\">Thus, as the Court of Appeals has stated:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Subcontractors may enforce their mechanics&#8217; liens against the property specified in the notice of lien and any person liable for the debt upon which the lien is founded (Lien Law \u00a7\u00a7 <a target=\"_blank\" href=\"https:\/\/codes.findlaw.com\/ny\/lien-law\/lie-sect-24\/\" rel=\"noreferrer noopener\"><u>24<\/u><\/a>, <a target=\"_blank\" href=\"https:\/\/codes.findlaw.com\/ny\/lien-law\/lie-sect-41\/\" rel=\"noreferrer noopener\"><u>41<\/u><\/a>). Consequently, the Lien Law grants the subcontractor an independent right, separate and apart from a general contractor&#8217;s remedies, to file and enforce a mechanics&#8217; lien against a person liable for the debt upon which the lien is founded, such as the owner, and the real estate being improved. However, the owner&#8217;s liability to the subcontractor is limited to the unpaid portion of the value or agreed to price of the improvements at the time the lien is filed (<em>see,<\/em> Lien Law \u00a7 4[1]). Thus, in the event the general contractor fails to pay a subcontractor with the sums the owner has already paid, the Lien Law protects owners from paying more than the value of the improvements, or the contract price.<\/p>\n<\/blockquote>\n\n\n\n<p id=\"viewer-5t73n514\"><em>West-Fair<\/em>, 157-58; <em>see also <\/em><a href=\"https:\/\/law.justia.com\/cases\/new-york\/appellate-division-second-department\/2020\/2019-00057.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em><u>NGU, Inc. v. City of New York<\/u><\/em><\/a>, 189 A.D.3d 850, 852 (2d Dept. 2020). \u201cMoney still due and owing from the owner to the contractor at the time of the filing of the lien, plus any sums subsequently earned thereon, is known as the \u2018lien fund\u2019.\u201d <a href=\"https:\/\/www.nycourts.gov\/reporter\/3dseries\/2013\/2013_07461.htm\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em><u>Peri Formwork Systems, Inc. v. Lumbermens Mut. Cas. Co.<\/u><\/em><\/a>, 112 A.D.3d 171, 176 (2d Dept. 2013). Lienor\u2019s can only recover from the lien fund. <a href=\"https:\/\/law.justia.com\/cases\/new-york\/appellate-division-first-department\/2011\/6116-115242-08.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em><u>IMP Plumbing and Heating Corp. v. 317 East 34th Street, LLC<\/u><\/em><\/a>, 89 A.D.3d 593, 593-94 (1st Dept. 2011).<\/p>\n\n\n\n<p id=\"viewer-2pcxi524\">Against this backdrop we discuss <a href=\"https:\/\/www.nycourts.gov\/courts\/ad2\/Handdowns\/2026\/Decisions\/D80696.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em><u>Layout, Inc. v. Heavy Metal Corp.<\/u><\/em><\/a>, a matter decided by the Appellate Division, Second Department, on June 3, 2026. <em>Layout<\/em> is a mechanics\u2019 lien foreclosure action.<a href=\"https:\/\/www.fhnylaw.com\/how-much-can-a-subcontractor-collect-on-its-mechanics-lien#_ftn1\" target=\"_blank\" rel=\"noreferrer noopener\"><u>[1]<\/u><\/a>\u00a0The defendant owner (\u201cOwner\u201d) in <em>Layout<\/em>, hired general contractor (\u201cGC\u201d) for a development project (the \u201cProject\u201d). GC hired a subcontractor (\u201cSubcontractor\u201d) to perform some of the work. Subcontractor hired a sub-subcontractor to perform some of its work (\u201cSub-subcontractor\u201d). Sub-subcontractor hired a survey company to perform survey work (\u201cLienor\u201d).<\/p>\n\n\n\n<p id=\"viewer-rvezo1594\">Lienor filed a mechanics\u2019 lien, which was discharged by a bond obtained from a surety (the \u201cSurety\u201d) by Subcontractor.<a target=\"_blank\" href=\"https:\/\/www.fhnylaw.com\/how-much-can-a-subcontractor-collect-on-its-mechanics-lien#_ftn2\" rel=\"noreferrer noopener\"><u>[2]<\/u><\/a> The Lienor commenced an action to foreclose the lien and to recover on the bond. The Owner and the Surety moved for summary judgment dismissing the complaint as against them. The Lienor opposed the motions and cross-moved for summary judgment. The Lienor appeals from the granting of the motions of the Owner and the Surety and the denial of its motion.<\/p>\n\n\n\n<p id=\"viewer-28t871663\">The Second Department held that all motions should have been denied. After noting that a lien cannot exceed the amount owed to the general contractor by the owner, the Court stated that the \u201clienor must establish the amount of the outstanding debt by submitting proof of either the price of its contract or the value of the labor and materials supplied.\u201d (Citation and internal quotation marks omitted.) The Court further recognized that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The lienor\u2019s right to recover is further limited by principles of subrogation. The subcontractor\u2019s right to recover is derivative of the right of the general contractor to recover, and if the general contractor is not owed any amount under its contract with the owner at the time the subcontractor\u2019s notice of lien is filed, then the subcontractor may not recover. \u201cThe purpose of this . . . is to limit the liability of the owner in the aggregate to the amount which he [or she] had contracted to pay.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p id=\"viewer-yvuih1797\">The Court then noted that the principles of subrogation are more complex with sub-subcontractors because \u201csubrogation applies to all tiers of subcontractor liens\u201d and, \u201ceach party is subrogated to the rights of the contracting tier above him or her.\u201d (Citations, internal quotation marks and brackets omitted.) Thus:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>in the case of a sub-subcontractor to a subcontractor, it may not enforce its lien for an amount in excess of either (1) the amount of money owed to him or her by the subcontractor; (2) the amount of money owed by the general contractor to the subcontractor; or (3) the amount of money owed by the owner to the general contractor. [Citations, internal quotation marks and brackets omitted.]<\/p>\n<\/blockquote>\n\n\n\n<p id=\"viewer-24xj22062\">The Court held that both motions should have been denied because triable issues of fact existed as to whether there was a lien fund from which the Lienor could recover. The Court found that the Owner and Surety failed to prove that \u201cthere were no funds due and owing to East Coast, to which the plaintiff\u2019s respective liens could attach.\u201d (Citation omitted.) Likewise, the Court found that triable issues of fact were not eliminated \u201cas to the existence of eligible lien funds for the Project.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p id=\"viewer-e69bo2327\"><a href=\"https:\/\/www.fhnylaw.com\/how-much-can-a-subcontractor-collect-on-its-mechanics-lien#_ftnref1\" target=\"_blank\" rel=\"noreferrer noopener\"><u>[1]<\/u><\/a> The facts as recited herein are simplified for editorial purposes.<\/p>\n\n\n\n<p id=\"viewer-q0zux2462\"><a href=\"https:\/\/www.fhnylaw.com\/how-much-can-a-subcontractor-collect-on-its-mechanics-lien#_ftnref2\" target=\"_blank\" rel=\"noreferrer noopener\"><u>[2]<\/u><\/a>\u00a0As discussed in our article \u201c<a href=\"https:\/\/www.fhnylaw.com\/mechanics-liens-and-discharge-bonds\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><u>Mechanics\u2019 Liens and Discharge Bonds<\/u><\/a>,\u201d an owner or a contractor can obtain a bond to discharge a mechanics\u2019 lien.
